Spouse Visa FLR M

Dear members,
My set lr just been approved and now I have to apply FLR M for my wife.
She has valid dependant visa until nov 2019. Do we have to apply now or that will be fine if we apply in November.

Preferably apply FLRM earlier than NOV 2019 to start her clock towards ILR earlier. Also if she travel on that visa then may encounter great amount of difficulties on return.

Thanks for the quick response.
We are planning to apply in mid October19 but just concerned if she will be considered as overstayer for periods Aug to Oct. As I am not on tier 1 visa anymore and she is dependent on it

Is there any check list thread for FLR M ?

Min Maintenance balance amount required ?

My wife current salary £21k from April19 and before that last year it was £18k. Will that be sufficient to prove threshold income ?

Bachelor degree from India, studied in eng medium will be considered for English language requirements?

There won't be any maintenance needed rather financial threshold of £18600. She will either need A1 ielts life skills or will have to use naric red route to get her degree be assessed.

Dear Seagul,
Many thanks for your reply. We both receiving regular salary income in the account but balance leaving under £100 only by the end of the month. I have been running a business and been investing all incomes on the business. Will that be an issue in FLR(M) ?

If you are receiving salary through paye job then your remaining balance in account wont affect anything. But to keep the less paper work involved either of you whoever earning sufficiently can use his/her income alone if its through paye job. Also you dont need to use self employment paperwork.

Dear members,

I have some more queries in regards to my wife's flr(m) application;

1) As guided, will only submit my wife's payslips for the last 12 months; her income was as follow:
Sep18 to March 19: Gross £1490 Per month x 07 months (Total: 10,430)
April 19 to Aug19: Gross £1750 per month x 05 months (Total: 8,750)

I will also submit a letter from employer confirming current pay £21,000 per annum from April 2019
Will that be sufficient to cross the threshold income £18,600 in last 12 months) or

2) Shall I wait to finish September month to have the same amount payslip for the last 06 months?

3) Every month paying part rent and transferring some funds form her account to my account, will that be creating any issue? Do we need to submit last 12 months bank statements?

3) Can I pay her IHS charge by my card?

2. Yes otherwise HO will take the lowest wages figure of £1490 which will result in refusal unless you combine your income/savings to cover the shortfall.

3. No issue.

4. If you will apply in september with 6 months payslips then only 6 months corresponding bank statements.

I will apply in 1st week of October and will submit April to September (06 months) payslips to meet the financial requirement. I recently got ILR and her visa valid till nov2019, do I have to explain UKVI why I have waited till Oct (02 months).

How long UK naaric assessment certificate will be valid ? Shall I apply now or apply a week before the application

You can do it now. NARIC can take a week or two to get sent to you.

We are living in my cousin owned house and contributing xxx amount per month. We don’t have any utility bills on our name. What documents will be requiring ? I have gp letters, poll cards etc..

To meet the accomodation requirement you will need the cousin noc letter, land registry/title deed, mortgage statement. Also if possible then council tax bill (totally optional)

Just about to make a payment to uknaaric.

Bachelor of Commerce degree from India, studied in eng medium will be sufficient for English language requirements? Will that be recognised by UK NARIC as being equivalent to a UK bachelor’s degree ?

UK Naaric telephone lines are closed today for some reason....and i don't want to pay £150 if the degree won't be considered as uk equivalent. I think i will put on hold until monday....

They will not tell you over the phone if your degree is equivalent. You will need to apply. They will also require medium of instruction/examination letter from the university/college otherwise your application will be at hold.

You will need to apply via their visa and nationality service.

For FLR m you need to show your degree meets the requirements of CEFR level B1.

I have recently got my ilr and in process to apply flr(m) for my wife in country application.
I have to travel india in emergency to see my mum and my wife need to travel next week.
Shall we apply while am abroad ?
Or what should we do in this situation?

FLR M is an application WITHIN the UK. You can't apply on FLR(M) outside the UK.

To apply abroad, it is a new entry clearance visa on form VAF4A, which costs more. She will need English A1 from an HO approved test centre and only YOUR proof of meeting the financial requirement. If she works in the UK, her income will not count.

You have to prove your income and subsisting relationship and any documentation you submit (the most recent bank statements etc) cannot be older than 28 days on the date of online application.

How are you planning to meet the financial requirement?? I don't the time or energy to read through the whole thread again. But if you are using your tier 1 business, there is a substantial amount of paperwork you will need.

You really should have applied for her visa using super priority service in August when you started asking questions.
