Hey Fifi, I really appreciate you keeping your post updated. It had been a while since I checked the forum, I’m sorry to read of the outcome your hubby received. What a time to have to endure a longer wait for an appeal :(

I haven’t yet. With the COVID-19 situation, I’m not sure whether to wait until processing times are back to normal or submit now and have to endure a longer waiting and wondering impatiently process :(

No, I haven't heard anything yet :( how about you? Did you apply?
I would advise to wait, otherwise you will be impatiently checking when there is no movement. Most of the biometric centres still remain closed so they won't be able to make a decision on your case until this has been completed anyway. Hopefully will start opening up soon.

Appeal won - 320(11) refusal

Hi,

I was going to post this under my original topic but it has been locked. I have heard back from the Tribunal after my appeal hearing and the judge has allowed our appeal. This was actually decided end of December and the determination was sent out early January which we didn't receive.

I know HO have 28 days to appeal, but I was checking my bank account lastnight, something I haven't done for a while and noticed the Appeal fee was returned to us last week also, confirming that the HO will not be appealing! This is the best news so far!

The next steps can be long but the wait in between knowing which way it will go is finally over!!

Timeline:
Appendix FM - Priority
Applied: July 2019
Biometrics: August 2019
Refused: October 2019 - under 320(11)
Appealed: November 2019
15 Weeks Up: 1st April 2020
COVID
Hearing: December 2020
Appeal won: December 2020
Appeal fee awarded and refunded: January 2021

It has been a long journey but I am so glad we are so close to the finish line - all thanks to the Almighty!

Huge congratulations - fantastic result. It's a big shame that it had to go that far and long in order for you to just get your visa!

08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Thank you!

Yes we did use a solicitor I don’t think it’s easy to overturn without their support.

The main reason the judge ruled in our favour was due to the amount of time that had passed since the overstaying and absconding incident. Also, the judge ruled that it would affect MY human rights to be asked to move seeing as I’m very well settled here in a very good job, with family and friends all around me.

My husband has submitted his passport now, so just waiting for that back!

I am so very grateful to God, without who this would never have been possible.

Where have you got to with your case?

Is there anyone who has recently submitted their passport for stamping after winning an appeal and waiting for this to be returned? I just wanted to see current timelines
