Spouse visa

Hi

I really need help
I get married in Egypt 2016 and I didn't divorce from my first marriage which it take place in Egypt as well
As we separated now from my first wife I want to bring my wife and my child to live with me in the UK
I have a british passport since 2015 and I know my second marriage won't be recognised in the UK as I took place while I am still marred to me first wife which I didnt know that would be an issue till I decide to get me second wife over here.

Can some one please advise me with the best way to do that?
Or its impossible to be done?

Apply for a fiance visa and marry in the UK. However, that's assuming you are now divorced from your first wife as you only mention you are separated. :?:

Yes we divorce already.

But If I applied for fiance visa, should I mention to the home. Office that I was married for second time as we do have a child? Or just apply for the fiance vise without mentioning the marriage at all?

You can explain the situation if you choose, this unfortunately is a common situation. However, you may be required to prove your parentage of your child, possibly with a DNA test.

One last question please :
I can provide what ever they want to prove my parentage to my child, however would it be possible to apple for a british passport for my child providing our marriage certificate and all the other prove they need and once he have it I can start to apply for the fiance vise for my wife? Would it that worked?

The marriage certificate won't be valid. Are you named on your child's birth certificate?

I understand that the marriage certificate will be invalid if I use it to apply for spouse visa.as it will show the marriage date was before I got divorce from my first marriage?
But I am going to use it only to prove my parentage to my child.

The reason I am asking is because I thought if I can get my child a british passport then I don't have to worry about him coming her also I can submit one application instead of two when I am applying for the fiance vise? And that will safe some fees as well I think?

1. Was your first marriage officially registered in Egypt?
2. Is your divorce officially registered in Egypt?
3. Do you have the original and translated Marriage Certificate from the first marriage?
4. Do you have the original and translated Divorce Certificate from the first marriage?

1: yes my first marriage was regesterd in Egypt
2: yes we devorce officially in Egypt and I have the certificate
3:yes I do have the official translated marriage certificate from the first marriage

4:yes I do have the official devorce certificate from the first marriage and its translated in English

An application for your child's passport could well take up to 9 months to process. You may want to consider applying for a Right of Abode (ROA) which would require you first obtaining their Egyptian passport. You would then apply for their British passport once they are in the UK. However, there are others better placed to advise further on this.

It looks like it's getting complicated somehow after the last advice, not sure now from where to start?

So, are you tiling me shall I start now to apply for british passport for my child (which it might take up to 9 months) to and then apply for fiance visa to my wife after my child have the passport? I am confused 😕 sorry

What about getting re-married in Egypt with a new marriage certificate dated after the divorce from my first wife?
Then I can apply for a spouse vise using the new marriage certificate? Would that works? Or it complicate things?

I had my sons British passport made while I was in Saudi as he was born there. I sent the documents with a family member to be posted in UK- this can also be done via international parcel company. We received the passport via international parcel company delivered at home in Saudi.

If your baby is eligible for British citizenship (as you said you are British) you should get a British passport regardless. Also, it didn’t take 9 months. I believe it was something like 3 weeks (this was three years ago)

Yes, I am a british citizen since 2015 and he born in 2017
So, I will go a head and apply for the British passport for him.,however what sort of paper work does thay ask for?
I know about his birth certificate as well as out marriage certificate, but what ells should I provide?

Hi,

Your most welcomed. It’s hard to think straight under stressful conditions.

I can’t remember what I provided. But something like birth certificate, marriage certificate, maybe my original British passport, baby passport picture and maybe also my spouses copy of passport. Attested translation of any documents.

Follow this link. It will tell you the process and all you need to know. It states it may take 12 weeks to process the passport from Egypt. But, what we did was apply from within UK as we sent the documents to UK to be posted internally.

Usually British passports takes 6-9 months from abroad but if its really legal to apply directly from UK by baby's mother/father then it might be a good news for manys.

I had my child’s passport posted to me in Saudi via British Embassy (I think) it was defiantly delivered to me directly.
Also, the person that countersigned the passport picture was also present in Saudi (although they were British)
I believe you might need British citizen to countersign the passport picture of your child. As it asks for their passport number or similar personal details.

It might be worth asking British Embassy in Egypt regards to obtaining the passport.
