UK national marrying a Japanese national

Hi Guys…

I have been reading through all the posts on these forums… Its amazing how many different types of situations and problems there are for people. I hope my questions are simple to answer.

I am planning to marry a Japanese girl for her to apply for a VISA to live in the UK.

I am independent and self employed for ten years, own my own property. Our marriage plans are based on our relationship of nearly three years, in which time we have visited each other on numerous occasions.

We originally planned to use the fiance VISA method, where she would apply for VISA then we would have six months to marry in UK. We have actually gone as far as filling in the application and assembled all the evidence etc.

But now we are thinking of marrying in Japan this summer. I am less sure about how this would work.

1) I need to post my intention to marry at a UK registry office for a certain period of time?

2) I need to get a Certificate of No Impediment from the local British Consulate? Is this easy to obtain? Is there a phone number or link for this place?

3) Will my fiance then need to apply for the married / spouse VISA?

4) I am worried that the marriage is fully recognised in UK, and how it will affect her eventual rights of immigtation, or anything else.

5) Does my marrying in Japan have any affects on my VISA / citizenship / rights etc?

6) Anything else you can add would be appreciated

To answer your questions;

3. Yes. She will apply for a spouse visa.
4. I don't understand this question. If the marriage is recognised by the UK, then she can apply for a spouse visa, to live (and study and/or work, if she wishes) in the UK. Is that what you mean?
5. I also don't understand this. What is your nationality and what affects do you think it might have?

as for question 4 - I was just wondering if the spouse VISA and the fiance VISA have exactly the same outcome. Is one method of VISA better than the other?

as for question 5 - I just need to know that by marrying my fiance in Japan, that the marriage is as legal as a UK marriage in UK.

The fiancee visa is valid for 6 months, and is used to arrange a wedding in the UK. She cannot work on this visa, as it is solely for the purpose of arranging the wedding in the UK. Once you marry, your (now) wife should apply for a spouse visa, which is valid for two years. If you marry outside the UK, she would simply apply for a spouse visa.

As long as the marriage is legal and you have your marriage registered (i.e. in a registry in Japan), then it will be recognised in the UK too. Make sure you get certified translations of any documents you submit if the original is in Japanese.

Thanks for that point... Sounds rather important. I think I will persue the marrying in Japan route. Thanks for your help.
