UK visa for adopted child

I am an Indian resident. My company is looking to transfer me to the UK on a Tier 2 (Intra-company transfer visa). My wife will be travelling with me to the UK.

I have adopted my younger brother’s child a few days back in India. We completed the adoption formalities under the Juvenile Justice Act in India. Will I face any issues with my adopted child’s UK visa? Is there any specific rule / process that we need to follow for the child’s UK visa.

Hello CR001,

Thank you for responding.

I still have one outstanding question. If i was resident in India and if I were to have completed the adoption in India (under the relevant Indian acts), will I then be eligible to bring the child back to the UK.

If I am not allowed to adopt while i am in the UK - the option before me is to give up my UK visa and head back to india. In India, i can complete the adoption formalities and reapply for UK visa.

Is that feasible. Thank you for your guidance.

Are you in the UK or not? Has the child already been adopted or not?

You will struggle (virtually impossible) to bring a child in the circumstances you describe, the immigration rules do not make provision for this.

I am in the UK. i am yet to initiate adoption formalities. if I am not allowed to adopt while in the UK, i will have to relinquish my UK visa and head back to india. I can complete my adoption process in india and then reapply for UK visa after a few months/ years.

I am wondering if I will then be allowed to secure the UK visa for the child.

Your link includes sec 310 which says

The requirements to be met in the case of a child seeking indefinite leave to enter the United Kingdom as the adopted child of a parent or parents present and settled or being admitted for settlement in the United Kingdom are that he:

Is it that I will not be allowed visa after a few years also when I reapply (considering that the rules apply to a "parent being admitted for settlement in the UK".

This is only relevant to people who have ILR or who are British.

Tier 2 ICT does not lead to ILR based on 5 years residence.

So then, if I were to head back to India after relinquishing my UK visa...and then reapply after a few months after completing the adoption formalities....will the adopted child be granted the UK visa.

What rules apply to an applicant for tier 2 ICT visa in that case.
