Voided and re-directed?!?!?!

Post by hlassell » Wed Jul 21, 2021 7:00 am

Anyone ever been told their app was "VOIDED and RE-DIRECTED" due to covid?!?

My daughter has applied for a family settlement visa (non-british child) to move to Scotland with me. I am a British citizen but can't pass on my citizenship (by descent) to her which is why she needs a visa. Her biometrics were done on March 22nd. Today is working day 84! BUT.....my MP gets an email from UKVI today (he said he wanted to know why it's taking so long) and this was part of the email:

"On 23 March 2021, we received ***'s application. Due to the operational constraints relating to the current coronavirus COVID-19 pandemic, on 24 April 2021, ***'s application was voided and re-directed to the relevant visa section for consideration."

So now what?! Does my countdown change with day one being April 24?!? Except April 24 was a SATURDAY so what the heck? From April 27 till today is 63 days minus 4 holidays so.... wd59? Do I have any hope of this process being done soon?!

This process is making my physically ill.

STILL NO NEWS AT ALL! Sheffield Escalations team won't respond to me. They haven't said anything since July 5 and all they said was "not straightforward".

This is the absolute worse service I've ever received anywhere. For a paid service you should have some option to at least get more info. They still have not once asked me for any extra info.

School starts next Monday. So now we have the added stress of her missing the start of school and being behind. :( This SUCKS!!

Not that anyone seems to care but working day 106 has come and gone.

Not true! I'm sure many users are happy to see a documented issue such as yours on the website. Please keep us all updated and we are thinking about you! Don't lose hope.

Awe thanks. Just had a moment of feeling really sorry for myself. :(

Friday (yesterday) was working day 111. It was also the 15wd since my 2nd escalation. BUT I never heard from the escalations team. Last communication from them was JULY 5. This sucks. It's almost September! And now Monday is a holiday. So who knows. The guy xxxx I've been in communication with via the UKVI email replied to me yesterday within 30 minutes and told me he immediately escalated it a 3rd time and said "I sincerely hope this helps!"

Well working day 112 come and gone with NOTHING!

And it's now 16WD since my second escalation.

WTAF?!?!?!?!?!?! How can they just ignore you!? Last time escaltions team sent me anything was July 5. So almost 2 freaking months ago.

F this whole process.

Validation, variation and withdrawal of applications wrote: (Page 24-5)
Void applications
An application is void when the Home Office cannot process it. For example an application for:

• limited leave to remain from a person who already has indefinite leave to remain
• applications for leave to enter or remain by those who are exempt from immigration control, such as members of the home forces or diplomatic staff - exemption is a matter of law
• leave to remain from a person who has their leave extended by 3C pending an appeal, unless the application is a human rights or protection claim – see: 3C guidance and for details on what applications are treated as human rights claims see the Rights of Appeal guidance
• an application for leave to remain from a person who is outside the UK without continuing leave a dependant’s application where the main applicant withdraws their application or varies their application to a route that does not allow for dependants
• an application made by a British Citizen or an Irish Citizen who does not need leave to enter or remain in the UK (see Common Travel Area guidance on Irish citizens) Common Travel Area
If the application is voided, it is my intelligent guess that the Home Office would have initially thought that the applicant (your daughter) was a British citizen by descent and therefore voided the application. What proof did you provide that you were a British citizen by descent and therefore your daughter is not a British citizen automatically? Did you at least provide a cover letter or explanatory note in the application explaining the situation?

It is likely that your application is bouncing around various parts of the Home Office (and likely at a senior level) with each team or office considering that it is not within their remit.

And calling the helpline won't do much. I work at a helpline (not the Home Office's, I hasten to add) and I can tell you that once an issue has gone above a certain level, it is probably easier just to talk to the walls or a stone for all the meaningful response that it will get you.

There is not much you can do at this stage. Probably instead of counting up the number of working days like a rosary, perhaps you should look at it in terms of working weeks or months.

Sigh. They literally blamed it on Covid. We're almost at 120 working days which is 24 weeks. Service standard is 12. Understandably I've run out of any smidgen of patience I had left.

Working day 119.

I woke up this morning to a missed call from UK! FML!!!! Checked my email and 12 minutes after the call (which they didn't leave a voice message) they sent me an email.

"Sept 9 email:

Dear***,
Regarding Visa Application: GWF*********
For: ***
The UK Decision Making Centre is currently assessing the application submitted by the above named. We are unable to conclude the application at this time as we require additional information.

We have been trying to contact the sponsor of the above visa application. I note that the only phone number provided on the application is one for the applicant.

Please send a phone number for your sponsor to the below email address so that your sponsor can be interviewed.

Please send this within 10 working days to sheffield.settlementdocsrequested@fco.gov.uk quoting your application reference in the subject line. Please attach the document directly to the email as we are unable to access links to files hosted on sites such as Dropbox™ or Google Drive™.

Kind regards,
UK Decision Making Centre"

The applicant is my 15 year old daughter. The phone number and voice mail state my name. Her mother/sponsor. It's really rich that they say they've been "trying to contact" when it's working day 119 and this is the FIRST TIME they've ever called or emailed me about anything!

Gawd I hope they try again tomorrow!! I've set the number as a "favourite" so that it will come through even if my "do not disturb" is on. *fingers crossed* And I replied to the email clarifying that the number they called is correct within 15 minutes of them sending it to me.

I just want them to call again! Tomorrow! But they probably won't. *fingers crossed* I kinda want to go to bed right now in case they do! And it's only 6pm lol

Bring it on. Ask me whatever you need. I just want this visa approved and the stress to stop. (OF course that's silly cause once it's official the stress is going to be high too.... I have to pack, sell my house, sell my jeep, book vet apts, book flights, book covid tests....)

Hahaha well you won't miss the call at least! And you never know! It might be that your case is finally being owned by an officer since it's clearly bounced around so there's a good chance they will get back very soon :)

Ah the joys of moving country, sounds like a proper adventure! I'm sure one step at a time you'll make it, with this visa hopefully being the domino that gets everything falling into place. Let's get you home!!

haha Right? I'll try and meditate or something before bed so I can get a good sleep and wake up early-ish.
I sure hope this is almost the end of the process. It's been pure hell!

I'm so excited and also nervous about such a huge move!

Thanks thats what I'm trying to do. It's sunny outside. Its not super hot so I can open all my windows in the house for fresh air. I'm just gonna try some more cleaning and organizing to keep myself busy.

Ok well UKVI finally called back again. A week later. I spoke to a lady at UKVI for about 20 minutes for an "interview". Gotta say it though it really felt like a waste of time. Like they wanted to act like they were doing something. Because it's working day 124 today and every question she asked me WAS ASKED IN THE ORIGINAL PAPERWORK. Not one question was new. Everything I already answered in the paperwork they've had since March 23. I am so incredibly frustrated. I asked her if she could tell me what happens now. She said she was going to "tidy up" her notes and then send them back to the ECO working on my daughters application. And from there "I don't suspect it should take much longer" was all she'd say. So.... sigh.

I guess we keep waiting.

Sure doesn't feel like it. She asked questions we already answered in the paperwork that they've had since the end of March. In 2 days it will be 6 months since her biometrics.

And the guy at UKVI ended our communication so in order to ask anything I'd have to pay to email again.

I can't freaking believe it's almost October and we're still waiting...

Hey :) Now that 6 months have passed, I think getting your MP involved to chase the application would be the next step since HO are taking their sweet time. Have a search on the forum to see how other members have contacted and successfully had a chase performed by their MP.

The MP has contacted UKVI on my behalf 7 times already since working day 60 and it's now working day 128. Doesn't seem to be helping at all. :(

It's been a week now since the phone interview and still no email about a decision (and no movement on the tracking - cause I check it periodically)
