Immigration problems for a single mum with 2 Danish kids

Hi there,

I was wondering if anyone can help with advice and direction. My friend is a former Soviet state citizen who was married to a Danish Citizen. They have 2 kids who are also Danish citizens. Regrettably her husband died over a year ago and she is now thinking to take her kids to live in Denmark as they are approaching a school age and she wants them to be able to integrate into Danish society whilst they are still learning. She applied for a residency visa to move to Denmark via Embassy overseas, which was refused due to failure to convince Immigration Service that she has sufficient reasons for the move. I understand that this is a fairly logical reason to allow Danish kids have a chance to actually grow as Danish (in my view this would be good enough). Can anyone recommend a good immigration lawyer who could help or to share advice if you had to go through similar problems. Both my friend and her kids are still in former Soviet state where they lived as a family even when their father was alive.

Which State is that? It could make a huge difference! Some former Soviet states are now in the EU!

Sorry, I should have clarified. The state is Azerbaijan which is non-EU. Thank you for reading

The Chen case provides that your friend and her Danish children can reside in an EU Member State other than Denmark, but not Denmark itself. That would be up to Danish national law, which I personally am not familiar with.

Reside - but not work.

Thanks for your replies and contributions. I guess in a way it would not make sense for her to relocate to another EU state as kids would not get an opportunity to learn Danish or be a part of Danish society. Plus even if she relocated let's say to the UK where she could potentinally live as she speaks good English before she can move to Denmark, then there is no point as she can't work. Surely Danish government can't stop it's young citizens from having a chance to integrate into a society. What does not make sense to me is that when kids become 18 and could move freely to Denmark, they would be disfunctional citizens who would not be able to speak Danish language.

I am looking forward to hearing from other contributors especially if you experienced similar problems.

This is the key point - it would be an issue that comes under the scope of Danish national only, not EU law. Hopefully someone who is familiar with the former will come and provide guidance. Sorry I can't help more. Best of luck.

Unlikely on a free forum. Best advice is to contact a Danish immigration lawyer or community group dealing with immigration issues.
