Immigration Status during Extn.

Post by kans75 » Fri Jan 20, 2012 10:38 pm

Hi

I am in the process of applying for my T1 gen extn. and have few queries:

1. If my T1 Extn. is refused very close to my initial visa expiry date
(say for instance,a week before my intial visa date expiry), How many days would i be given to leave the country?

2. If there is a delay in getting the decision, what will be the status
of my dependants, if not applied at sametime and run out of their visa dates?

Awaiting for all your valuable replies.

Hello Everyone,
I am applying with my wife for T1(G) extn. shortly due to employment reasons.
I am planning to apply for my child later once we get our results.

I understand that child does not need a visa to leave the country(UK) but needs one to enter or to remain in the country(UK).

My queries:
a.Is it OK for me to go ahead and apply without my child's application?

b.What happens to child's status incase my extn. is delayed/refused after my current child's visa period?

c.Will there be any issues at the airport for the child, if we need to return back to home country?

All your answers will be of great help and any persons who have experienced similar situation please respond.

Advance Thanks.

Regards
K

Dependants should apply shortly before their leave expires, to prevent overstaying and preserve the right of appeal.

Child born in the UK does not need to make an application for leave to remain, if child had not been previously given any leave.

Hi Vinny,
Thanks for your reply. My child was born in 2009 and i applied for her visa of leave to remain that time.

It is just that this time i have some time left for her visa to expire and we are applying a bit earlier before our visa expiry for employment reasons and incase if the result gets delayed and i don't want the child to be victimised of illegal status or so..

Is there any other way of not risking that extra money for child's visa immediately and apply after our results?

Your suggestions are highly valuable for me.
