IMPORTANT!!! Recent Tier 1 extesions less than 3 yrs

Recently, UKBA has been issueing extensions to tier 1 (Switching from HSMP) applicants which are infact few weeks shorter than the full duration of 3 years.

I do not know whether it is done by mistake or as a rule. But, it will certainly cause a lot of problem when these people apply for ILR. As their aggregate leave would fallshort by few weeks of five years which will make them disqualify. Rules say
"The applicant must have spent a continuous period of 5 years Lawfully in the UK"

Most likely they have to take extension third time.

Has someone written to UKBA to clarify this matter or got them to correct it??


Anyone has a say about it. Your comments much appreciated.

I've seen posts where people were awarded additional days to the 3 yrs leave, for meeting the ILR eligibility. Basically we need to mention this in the covering letter. However, as I've heard some of the case workers are relatively experienced, and some of them ignore this request on purpose.

I've heard that you can apply for ILR up to 28 days before the 5 year period ends, so people with a week or two too little might be ok.

If u r 4 weeks short then its gonna be fine otherwise u got to go for another extension..
