incapecity benefit and marrage visa

Post by gigikhanoom » Thu Feb 05, 2009 11:55 am

hi I'm UK resident I am living in London for about 18 years. About 7 years ago married to the girl in my back home country (Iran). After we married she went to British embassy in Tehran (2002) and applies for settlement visa and she have been refused because I'm on medical support and claiming incapacity benefit for my illness for about 10 years.
After that we've been told, you can appeal against that decision which we did but after 18 months waiting, because my situation didn't changed they refuse us again in the court in London. In 2006 after I was start working for few months she went to British embassy and applies and she has been refused again Any way I couldn't carry on with my job and stop working. By the way I need to tell you that when I was working I didn't stop to getting benefit that's why we didn't appeal and that was the last time she have been in British embassy. I would like to know in the civilise country what kind of human rights is which separate the couple because one of them can not work?
My wife is working as a midwife in Iran and has good salary and saving to support herself which we show them all to the embassy but they didn't accept! At moment I'm claiming incapacity benefit but for last 2 months I did claim no council tax and housing benefit and still don't know what I should do. Would you please help me and let me know what the best way to solve the problem is. Thanks for your prompt attention to this matter.

Your case is quite complicated and I think you really do need to seek professional advice about how to proceed.

As regards your wife working as a midwife, how good is her English?
