Including Baby Birth Certificate on EEA2

Hi,

I am about to apply for an Residence Card application and to show proof of residence I have included the birth certificate (together with hospital letters) of our baby who was born less than a month ago. We are married.

The question is: will this cause any problems as my non-EEA wife is only doing the application for her self and not any dependents.

Well the baby certificate doesn't prove that you live in the UK but on other hand there is no legal requirement to prove that. You should be fine. It doesn't matter that the baby is not applying (especially if the baby is EEA national).

We will include the proof of residence just to be on the safe side.

The proof of residence is hinted for the non-EEA applicant (if I'm correct), who is also the mother of the baby and she has given birth in the UK. Additionally, her passport is still with the HO so she can't have left the country.. taking everything into consideration it is apparent that she's still a UK resident based upon that alone.. I guess..

if the child is non eu national too RC can be applied but if child can get eu nationality than EEA2 IS not required.
and birth of chld does not necessary means that mother is resident there are certain requirement even for british citizens to classed as resident ,
even if a british citizen lives outside uk more than 6 months in a year would not be classed as uk resident.
