Income based JSA and ILR

Post by starletuk » Tue Mar 05, 2013 5:21 pm

Hi,
I'm new posting on the forum but have always been a silent reader.
I am a UK British Citizen and my husband is a Pakistani National, we successfully applied for FLR(M) at PEO in March 2012 (pre July 2012 rules). He is due for ILR in March 2014.

I was made redundant in February 2013 and currently actively looking for a job, my husband is full time employed and has been with the same company since 2010 and earns around £22,000 before tax.

If I claim income based JSA (I have not paid enough NI for contributions based), will this effect my husband receiving ILR in March 2014? I'm hoping I will find a job pretty soon but with the current work climate, I'm not sure.

My understanding is that I am the sponsor, so I should be able to support my husband, so if I am unemployed and on JSA, will that effect him receiving ILR?

Will it impact the application as the UKBA will look through previous bank statements and see I was in receipt of JSA.

Also am I correct in that I will have to make a joint JSA claim but I will be assessed as a single claimant as my husband has 'no recourse to public funds' and therefore his income does not impact how much JSA I receive?

I am aware I will have to explicitly state to the DWP that he has 'no recourse to public funds', can I apply online for JSA and give information regarding this or is it best to call them to apply?

Thank you for your time and sorry for the long post - just wanted to make sure I gave all info possible.

a single payment of IB JSA is 71/week for an adult.

your partners income is used and £ for £ deducted.

22000 / 52 weeks > 71. :) and therefore not worth claiming... / waste of time...

your husbands income has to support you through these difficult times. (i know its tough, but :) ) - GL with your job search
