Can a person in country change his/her immigration status as a spouse of Britain national if he/she is already living in Britain on Tier 4, PSW or old student visa? Or in other words can a person apply for a marriage visa without leaving UK if he is on old student visa, Tier 4 or PSW. Cos I heard now in new point based system a person can’t in-country change its immigration category, but what if a person is living under old rules like on student visa? Many thanks

Yes you can and I can give you a practical experience: I did it and was successful. I changed my status from PSW to spousal visa but if you're thinking it was an easy ride, think again. Don't attempt it unless you're definitely sure it is a genuine relationship. The guys really mean business this time round. You might even end up in jail! Think on it.

The OP wasn't talking about getting an easy ride. He probably wants to be with his partner and not be seperated for the application process. So what's with jumping to conclusions and saying that he'll go to jail?

I'm sorry ElenaW but from personal experience, I know, that people who post their issues on this forum usually give the 'ideal hypothetical scenario'. If you're desperate, you tend to subconsciously assume, that anyone with a bit of insight into immigration issues is actually the caseworker who would be considering your application.

You didn't expect the original poster to have said, " I want to change my visa status from student to spouse by paying someone for a sham marriage", did you?

I'm not prejudging but I'd rather be told the truth than a sweet lie.
