Indefinite leave to remain and overseas travel

Post by robdel100 » Tue Apr 15, 2008 3:18 pm

I would be very grateful for any advice. I have looked through 'FAQ's' and other posts but cannot find the answer.

My wife is an Indian Citizen and soon will have been in the UK under the work permit arrangements for 5 years ; we are soon to apply for indefinite leave to remain. I am British.

Our concern is as follows:

We went on holiday twice to France; we overlooked that fact that my wife needed a tourist visa to go there; however we entered and left France without any problems despite this. These entries (to France) are stamped in my wifes passport but of course there is no visa; in retrospect we, or my wife, technically entered France illegally, albeit unwittingly. Could this cause a problem for her application for ILR?

Thank-you very much for your help.
Robert

Not at all,
Your trips to France would cause no problem with the ILR application; only if she was detained and convicted then it may cause problems.
In your case, that was a honest mistake, no problem

I do not think you have a cause to worry. As the wife of a British Citizen she is entiled to free movement in the EU and does not need a visa or is obliged to be given one free of cost on arrival provided she is accompanied by you. It is not as if they have 'overlooked'. It is an entitlement.
Cheers,
