Indefinite Leave to Remain - Please help.

Post by nvr » Mon Sep 26, 2011 3:19 pm

Hello experts, Please give me suggest me something..Sorry If iam posting the same question again but I spent 2hrs to read and gather information I didn't see anyone in similar situation.

My history:

HSMP applied with in the UK in Oct 2006, Approval received dated 29th Nov 2006.

Went to India to get it stamped/Entry clearence on Feb22nd 2006
Board of entry 1st Apr 2007
Got extended for 3 years and my visa wil expire on 1st Apr 2012. So I can go for ILR around first week of March 2012. Recently I have checked my passport I travelled to India 93 days at a stretch. During that time I have used my holidays for 5 weeks then I was not well and employer paid for sickness. I submitted a doctors note from India and employer accepted it. Arrived Ind on Aug18th'07 returned on Nov 18th'07. Because of 31days in Aug and Oct it was 92 days long and on the way back flights were cancelled in Dubai due to adverse weather conditions I had to wait for 17hrs to catch my next flight to LHR so all this together it sums up 93 days in my single trip. So i really appreciate if you can through some light on my problem. BTW overall I was away only 130 days in my 2 trips in 5 years.

What supporting doc's can i submit to over come this problem.

1) Can I get a letter from my employer to prove that I was on holiday and sickness during my holiday and I also got paid for this??

2)Can I submit a sick note from Indian doctor?
or

2) Do I really need to go for my second extn?

Thank you in advance experts.

1. Employer can only certify your work related absences and absences on account of (annual / paid / unpaid) leave.
2. Depends on what the doctor's note will state - the medical condition and your inability to travel to UK because of the condition.
3. Your call.

See also excess absences.
Life isn't fair, but you can be!
