Hi Mani,

On which rule you are saying when you apply JR your continuous residency broken , it is appeal on decision and 3c/3d says you continuous carry on extend by law.

Please explain on what basis you are saying this.

Just wondering why didn't you apply for your family on FLR(m) instead of FLR(o). Was there any reason?

Hi many Congratulations..
Did you expedite your case?, or contacted MP for complains,,etc.?

Hi Hyper....Sorry about the late reply.. Still reveling... :)

No I did not expedite my case nor did I contact MP. Though about doing it but the MP for my area is Conservative so that put me off a bit.

I did however write a complaint email as per advice of someone here that posted a very nice and polite template... (Thanks a lot to whoever it was by the way, don't remember right now exatcly). However, I can't really tell whether that made a difference. I never got a proper reply, only the automatic one about 20 working days for a proper answer.
I did get the visa a couple of weeks after sending the email but not sure. A lot of people also wrote to them and nothing happened.

Anyway, for whoever wants to send a complaint, here it is again... It can't hurt I reckon.

Dear Sir / Madam,

I have read on UKBA website that Home Office welcomes feedback to resolves the complaints and improve the services. I would like to bring to your attention an issue related to service standards regarding ILR application process under the long residence category.

I've find out that many applicants who applied on SET (O) 10 years lawful residence category from mid-July 2012 to mid-August 2012, including myself, are still waiting for their final decision from UKBA, whereas some applicants who applied in late August 2012 and early September 2012 have already received their final decision. This information is available at various forums where applicants share their visa application timelines.

In my case, it has already been more than XXXX months that I sent my application and I'm still waiting for a final decision.

I believe it is Home Office procedure that applications are processed in the order they are received until there is any compelling circumstances. With applications sent at later dates receiving their final decision, this has become a reason of concern for applicants who sent their applications earlier and are awaiting a final decision. Could you please investigate or raise it with the teams responsible to process SET (O) long residence ILR applications.

It would be much appreciated if you please raise this concern with the relevant team.

Kind regards,

Hi,

I sent this email to UKBA on 8th March and shared on the forum. Not taking the credit but I am glad that few of us who sent same email and got their visas. I applied on 11th August & still waiting and did not get any reply from UKBA regarding complaint email.I think its now pure luck which application gets picked up by the caseworker. Hope every one get their decision soon.

Nat , Ged or Damanisshallo

Just a quick question,
How to fill the section just below 6.8 page 15 of the FLR(M) Form which says
“Add all addresses you have lived at in the 2 years preceding this application if you are applying as an unmarried partner or same-sex partner and have lived at your current address with your sponsor for less than 2 years”

Because we didn’t live at the current address for the last 2 years and there is no other place to add our previous address but only this place on FLR(m) form. How can we add our previous address:

Also how did you fill 1.17 on page 7 which reads

“Please give details of any previous passports, covering the last 10 years, including where these passports are now”

The space there is so small, what can we write of the previous passport.

And on page 39
10.12. Please state what ties you have with the country where you were
born?

this section is added in the new version 04/13

ILR 300 Days GAP-in betweeen .

Post by joe55 » Sat Apr 06, 2013 8:59 pm

Hi
I know I am rushing up things and its too early to worried about but I just want to conform this before so that I can start looking for other options. I came to UK 2005 October as a student I done my Diploma, Bachelors and my Masters completed in 2011 March.

I applied for my PSW and granted from 2011 March to March 2013 and this time period only literally I was out of UK for more than 30 days. From 6th July 2011 to 04 April 2012 something around 310 days .

I applied for my tier 2 WP and waiting for the decision, So if Apply for ILR in 2015 this huge time gap will be a problem for me. I am just wondering.

I appreciate the time you taken to read and thanks in advance for your replies
Thanks
Joe

Because we didn’t live at the current address for the last 2 years and there is no other place to add our previous address but only this place on FLR(m) form. How can we add our previous address:

I could not understand the question. In form there is space available for 3 past addresses on page 15. You need to write the addresses in available spaces and the date when u started living on that address and date until when u lived there. If you have more than 3 past addresses u can add it on spare sheet.
PS: I did not wrote any address in this section because I am living on my current address for more than 2 years now.

Also how did you fill 1.17 on page 7 which reads

“Please give details of any previous passports, covering the last 10 years, including where these passports are now”
As far as i understand, you should attach your all those previous passport with your current passport which have UK visas and stamps and send them with application. Suppose u have 3 previous passports u can write e.g. "All Previous 3 Passports with are enclosed"" You can mention passport numbers and nationality(country of passport) if space allows you.

The space there is so small, what can we write of the previous passport.

And on page 39
10.12. Please state what ties you have with the country where you were
born?

This question was in old form as well, I wrote my country name in "Country" and 'Parents' in ""Social cultural or family ties"" as i don't have any other nationality and not lived anywhere more than 5 years except my home country where my parents are. i didnt mention about other family members, relatives or friends there. Just wrote Parents.

I am afraid you have exceeded your absence allowances for ILR on 10 years lawful stay basis. you can not be absent from the UK for more than 180 days at one stretch.
Information or Advice provided by me is general in nature and based on my own limited expertise hence shouldn't be used as a substitute for professional advice where necessary.

Yes its right you have exceeded the permit absence which should not be more than 6 months-in one go and total of 18 months in whole 10 years But still not the end of world if u have genuine and strong reason to prove u can try ur luck

Thanks Shazib ,
During that time I was working for a UK registered company as a BDE , and I was getting paid in India. I dont know whether they will accept this or not what are the documents I should prepare. I was wondering if I could have apply for Subject Access Report (SAR) so that I can get a clear picture, is it worth it.
Thanks

By the grace of Allah at last got my freedom. A mountain is removed from my head, has been very tense time.

Received my ILR docs on Saturday, but very busy to update the forum. My time line

Applied 10 yrs basis: 22/09/12
Ack : 29/09/12
Bio Received and done 01/12/12
ILR Approved: 04/04/13
Approval Letter with docs received: 06/04/12
BRP: Waiting
Time taken: 6 months and 14 days.
The docs received in the Special Delivery Envelope that i enclosed with the application. i was tracking the No.

I did send (post& fax)a letter of expedition on 25th March due to some illness back home , don’t know it helped or not. I sent the letter myself, no MPs involved.

My ILR approved hardly a week before my wife visa expiry, but luckily a PEO appointment in Croydon has already been book on 11/04 on the advice of respected Damanisshallo. It was booked in anticipation like 2 months ago.

Now we have to attend this appointment, i know i have to fill both the forms FLR(M) and SET(M) and will try our luck.
Any advise in this regard, any rules that i can print and take with and refer to while convincing the case worker.

I have also to apply for my 2 babies on MN1 as both were born in UK.

Finally i will offer my heartiest thank s to all you guys in this forum, especially to the GREAT Damanisshallo who is always ready to help and support. Keep it up Daman

New form SET (O) for ILR - 10 year rule

Post by gryphon » Sun Apr 07, 2013 6:38 am

Dear All

I am big fan of this forum as it has always helped me to get up to date information on the changes regarding immigration rules. I read some previous posts here and agree that, sometimes the information received here are far more helpful than consulting with a lawyer.

I was checking the new form for SET(O) applications and was also comparing with the old one. What I noticed was that they got rid of any indication of 10 year long residence route. Previously there used be a specific category mentioned in section 3 of the form. I am referring to the previous version of the form (13 Dec 2012). SInce they got rid of it, there is hardly any information regarding the applicants of 10 year rule.

Can some senior member please advice whether the new move reflects any major change on the 10 year settlement rule? Is there a different form for this kind of application now? I am asking because I would qualify for settlement under the 10 year rule in Sept this year. Although I know its still a long time before I can apply and the immigration rules here changes faster and more sproadically than the weather. However, some prior information regarding changes is always helpful.

Thank you all who took the time to read my message and I would hugely appreciate if any member can give some information on this matter.

Best wishes

Congrats. For mn1 better if apply through nationality checking service. For croydon peo i think they ask for set m rather than flr m as mentioned in past posts. U can take print outs of 287(a)(i)(d) and 319AA and the FOI as damanisshallo advised in my previous posts. Follow 4th n 5th april posts. If u r on settlement route then u can apply directly for set m at croydon hopefully. Damani can advise better. Good luck

Hi M2013

Here it is:

http://www.ukba.homeoffice.gov.uk/sitec ... ment/setlr

Looks quite strange. They ask for 10 yrs of council tax and utilities bill. How is one supposed to get 10 years of those. Senior members please comment.

Cheers!!
