Got my ILR

Post by missniu » Wed Apr 24, 2013 5:07 pm

Got my ILR yayyy!!!! Here is my timeline and (short story below)

Application date: 16/08/2012
Acknowledgement: 20/08/2012
Biometric invite: 19/11/2012
Biometric done: 23/11/2012
ILR Approved: 19/04/13
BRP Received: 19/4/13
Documents Received: 24/04/13

Before getting to the destination of this long journey, I wrote to my MP who was very helpful. She always sent response the same day when she had not heard from the home office. This happened 3 times.

On the morning of the Friday 19th April, I called the home office and they told me my application is still pending.

Out of frustration at 12.10pm on the afternoon of the 19th, i decided to write to Rob Whiteman, CC'ing Theresa May (as advised by a member of this forum).

On Monday 22nd April, I received an email reply from the secretary of Rob Whiteman advising that a decision had been posted to my solicitor (at this point, i think I started shaking). I called my solicitor but he had not received anything in the post yet. The next day (yesterday being Tuesday), my solicitor rang me in the morning to inform me that my ILR had been approved. I burst into tears and called my parents back home who did the same. My sisters here jumped for joy for me, 8 months wait is no joke!!! I pray everyone received their documents asap, in Jesus name.

I know everyone's ILR will come soon, but it's just a matter of time.

So today has been interesting. My university sent me an urgent letter asking for documentation of my visa. I brought in a copy of my ILR application a few months ago but they said the UKBA wanted confirmation about my visa application. I sent a letter back to my uni informing them that the UKBA is where they need to look for this documentation and cc in the UKBA, my MP, and Rob Whiteman. I received an email shortly after I did this which informed me that my case was with a worker today and once a decision was made they will contact me. I got a phone call from the case worker confirming a decision was made and that my documents were being sent out today. I am still not sure what the decision is but fingers crossed it will be positive. I paid for next day service so I believe my passports will be sent to me by Friday at least and then I will have to wait for my BRP. My flights were booked for Sunday but was told that it could take up to a week to get my BRP....I will keep everyone informed and will post my application details after I receive confirmation either way.

I varied my FLRO application after completing full 10 years using SETO form. I paid full amount again for SETO instead of paying the difference between FLRO and SETO fee as I called ukba and they directed me to pay the full amount. Recently, I got a letter from case worker that I should withdraw one application. If I withdraw FLRO application then can it curtail my 3C leave whilst I've spent more than 10 years in UK now and can it make invalid my SETO application. I'll be very grateful if any senior member help me here.

Hi all - received my passports today but still awaiting BRP card...really happy it's all over (almost, pending the BRP, provided it's not lost yet!)

Background: 6 years student visa, 1 year permit free visa as a doctor in training, 3 years on Tier 1 (General), No gaps.

*No solicitor used* :)

Documents included in application:
Passports
LIUK certificate
SAR file

Note: My home country somehow does not stamp when I enter the country (I don't know why) and similarly UK does not stamp your passport when you leave. So, naturally, I lost track of my entry/exit dates between 2003-2007 as I didn't think at the time this was important. So I only wrote down the dates based on all the stamps within the passports and filled in the rest based on the information from the SAR file. I tried to also include as many dates as I could recall as possible (ie by checking airtickets on my email account etc) which were not in the passport/SAR file.

Timeline....

Application date: 03/09/2012
Acknowledgement: 10/09/2012
Biometric invite: 17/11/2012
Biometric done: 17/11/2012
ILR Approved: 21/04/13 (Sunday? WTF?!)
BRP Received: Pending
Documents Received: 24/04/13

So, almost 8 months in total. It has been a bumpy ride as I was nearly not allowed to work. Wrote lots of complaint letters, and contacting my MP (Conservative borough in London) was frankly a waste of time. Had to cancel a holiday.
I am STILL glad I wrote a letter to Rob Whiteman, Teresa May and the Immigration Minister as I believe this worked (despite some of the bitchy feedback I got on here in response to this - BITE ME!).

Thanks to all the helpful people here, esp Idiot spammer.

VOLO Process wrote:Withdrawal of first application (not travelling)
Where an applicant who is not travelling, makes a clear, unambiguous request for consideration of the first application to be discontinued, VOLO leave will terminate 28 days after the date of withdrawal of the first application. If such a request is ambiguous, clarification that the application is being withdrawn should be sought. Only once a clear, unambiguous request has been made can the VOLO leave period be allowed to continue. Where such notification is given by post, the date of postage is when the application is withdrawn and the last 28 days of VOLO leave are triggered by that date. Any second application will only attract a right of appeal if the decision is taken, appeal rights notified and an appeal lodged during the extension under VOLO. The withdrawn application should be notified on INDECS using result code 7 and category code X1.
My personal suggestion is to withdraw your FLR (O) with a clear written intention why you are withdrawing your application and on whose advise (mention the caseworkers name)

Wife's FLR m approved

Post by jitu_2677 » Wed Apr 24, 2013 10:27 pm

Guys more good news. my ilr was approved on 18th April, today i got my wife's passport dated 23nd April. just to inform you i didn't send my passport or biometric card. So it looks like home office don't need those, they can check on their system.

only 1 issue surprise me. My wife is in transitional route as she came here before 9th July 2012. so she should get 2 yrs visa. but they gave her 2 and half yrs visa under new rule.

so my question is can she apply for ilr (SET M) as she completed 2 yrs residence as a tier 1 general dependent.

1 quick question

did you both (your SET (O) and your wife's FLR(M)) applied at the same time?? or did you applied her FLR(M) days after you sent your SET(O),,... Did you contacted the Home Office after you got your ILR by any means...Phone, letter, fax, email...etc

Please share this information ... so we will have a lot of relief regarding this issue

and also @ Ged if your still seeing this forum and reading this post..please let us know whats your experience with regards to the above question

9.5 motns and sick of waiting

Post by Hwima » Thu Apr 25, 2013 8:45 am

Hi all

As some of you who have read my contributions already know mine is a million miles from being a straight forward case. Previously my wife has said "let the sleeping dog lie" but I have decided I've had enough of that.(hope she wont say I told you so). I phoned the UKBA this morning and just as she was dishing the default answer I started writing the MP. I trust she will do something about it. What she will do I don't know but she's more human than the other lot as she has been sympathetic with other constituents with immigration issues in the past (hope she won't disappoint).

So I'll let you know what transpires as the motion is set.

Good day, happy waiting 8)

Yes case was fairly straight forward - had one application out of time but within 10 days - so I dont think I had any concerns there
I had to escalate my case - I had first asked my MP but nothing really progressed - I then wrote an email complaining to Rob Whiteman and I think that pushed my case - got reply from his department with in a few days that my case has now been allocated and will get a reply in 7-10 days - and within a few days of that reply got my approval letter
hope this helps everyone waiting

There no such template for writing to MP, just write in your own words, polite, precise with no harsh words.

Give more info and why you want to speed up your process with your case ID, ref no , nationality, DOB, full name and address.

Use www.writetothem.com

Hi

Quick update. Within 2 hours the MP's office had come back with info. The background checks for someone whose application is under consideration were completed recently( even gave me date). Now its between to teams in Liverpool office "back and forth" as she put it accross. I will have to give them (mp) evidence if I have grounds for expedition

Thanks people.

April contacted MP and spoke on a weekly basis with his assistant.
They wrote a letter and called the hotline for me.
I also wrote a letter to Teresa May, Rob Whiteman, and home office and when they responded I continued to ask questions.
Case was assigned to a work team around 19 August 2013....case worker assigned 24th ...decision made within two hours of being assigned to a case worker.
ILR letter and passports: 25 April 2013
BRP: waiting

I really need to get this BRP card back by Saturday to make my flight. Contacted the department that deals with BRP and they said my card had been made and will be sent out and to expect it in 3-7 working days....fingers crossed it gets here by Saturday.

Hope this helps others to understand the process. I would suggest not writing to anyone until the 7 and a half marker. I think after that you have legitimate causation to write.

Everyone I spoke to at the UKBA have been very helpful and kind on the phone...minus one person...but they could have been having a bad day.

Keep patient and wishing everyone much luck! I will notify when the BRP card comes. :)
