Hi,
I would like to ask that if you could please have read of the background detail of my previous post? could you please let me know whether it was risky for me to apply for ILR in September 2012 or maybe I would be fine? As the waiting gets longer I come up with assessing all the records.

Novice's opinions here.

1st bold: Were you legal during the 7 weeks period (which is less than 49 days)? For example, if an applicant finishes an undergrad in June, the visa expires on 31st Oct and the applicant returns to the country, and then the applicant starts a Master's in Jan and the visa starts around the time of xmas (obtained through a British consulate). There is roughly 7 weeks legal gap. I think this gap is acceptable (and reasonable).

2nd bold: I think many people are missing stamps when going out and entering the country. This is not traveller's fault. It's the administrative error that belongs to the home office.

Underlined: The waiting time has been around 8 - 9 months and from one of the previous posts which was based on a document obtained using the information freedom act (or something like that) stated that as of 10th April, 1850 July applications (on Set(O)) are still outstanding/pending. You might have to wait a couple of months to hear from them.

Congratulations on your freedom. I am 11/08 applicant and still waiting.
Could you please share email addresses and complaint emails that you sent to UKBA or any postal addresses, fax number. I complaint to my MP but not getting any positive response from him.

Thank you Damanisshallo. Actually the caseworker who started working on my FLRO application he sent me letter asking about withdrawing of one application and I'll defintely withdraw my FLRO (initial application) which I submitted to complete the shortfall in 10 years. I'm surprised that I clearly mentioned in covering letter that my SETO is actually the variation of the initial FLRO application but they still put into the fresh application. My only worry it may affect over my SETO application?

Did u mean the HO didn't request for another biometric registration?

For members who are in a dilemma on whether to lodge a complaint or not. It does put them on their toes....

This probably created the backlog in the first place though. I am glad that some are getting an earlier decision, but it might not be caused by them writing a letter of complaint to the home office. It could simply be that they have a family, dependent, and their cases could be considered relatively "compassionate" hence can be fast-tracked. I would ideally like the home office to deal with cases in the order they are received.

It's like the university admissions system. If you make one exception, you have to make another one too. Soon, we have a system where the admissions process relies on the luck, not the qualifications/achievements.

And don't forget that some applications despite a number of complaints from applicants themselves and MPs are still pending more than 9 months after the receipt of the applications.


According to my Excel sheet, it's been more than 245 days for me.

In case anyone doesn't know, you can calculate days using now() - this function gives you today's date minus your date of application (in the same format). This gives you the exact number of days.

I raised the matter with UKBA through my MP XXXXX - as UKBA customer service had only one unhelpful answer "Your application is in progress. Please continue to wait.".
Following information was transmitted back to me :
As on 01-MAR-2013 my application wasn't allocated to a caseworker.
As on 05-MAR-2013 my application wasn't on UKBA database and would likely be added by spring time.

My Complaint:
1. Applications made after mine have had their applications decided - while my application wasn't allocated to a case worker and most likely hasn't even been opened. UKBA promises that they process applications in the order they are received - and this clearly hasn't happened in my case.
2. UKBA has seriously delayed my application processing beyond their published service standards. This is due to maladministration at UKBA and no fault of mine. This uncertainly and total lack of transparency has caused me and my family tremendous mental stress, prevented us from travelling outside UK to visit to my ailing parents. I consider this as a breach of my human rights.
3. I have received a shambolic customer service (0870 606 7766) - where the UKBA staff was not even willing to listen to my concerns and worries and had absolutely no answers. It was like as if I was speaking to a tape recorder.
4. I was contracted to do IT work for a client and it got completed on 22-FEB-2012. I had made my MP aware of this with proof of completion of contract. Since then I am unable to attend job interviews for new contracts as all employers demand the following to schedule an interview:
A proof of identification
A proof that I am legally allowed to work in UK and have enough time left on my permit to be able to fulfil my job.
Both of these above, requires me to present my passport and BRP - which I don't have because UKBA hasn't processed my application within the timelines that UKBA themselves have published.
5. While I am unable to find work forced by the delays caused by UKBA, I have to pay for me and my family's living expenses out of my limited savings as I do not I have recourse to public funds. Is it justified that I should put my career and finances at risk because of UKBA maladministration and infact pay for that out of my pocket?
6. UKBA suggested me the following options:
Put in request for my passport temporarily (1-2 days) for identity checks by employer. This is to be done by following a process that is supposed to take 20 working days. There will be several interviews scheduled over a period of time - so for each interview scheduled does UKBA expect me to put in a request for return of my passport and wait for 20 days for it to arrive. This again is not acceptable to me.
Withdraw the application and apply again at a suitable time. This would involve forfeiting my application fees , losing out on over 7 months and make a fresh application and waiting for 20 working days for my documents to arrive. This again is not acceptable to me.
Present compelling and compassionate reasons for expediting the processing of my application. This is really surprising to hear because after UKBA knows that they are at fault, and they haven't actioned on my application in over 7 months now - its time UKBA should take the responsibility and ownership of taking the earliest possible decision on my application.
7. My kids (details above) are due to start their primary schooling in a years time. We have planned to buy/rent a property near a good school - this has gone haywire as we cannot apply for a mortgage or produce identity documents for pre-tenancy checks. UKBA delays have seriously jeopardized our plans for providing a good schooling to our children denying then their basic human right.
8. This delay from UKBA will eventually cause a delay for me and my family's citizenship/naturalization application - again attributed to delays caused by UKBA and no fault of mine.

Please provide answers to the complaint above (all 8 points) above and also advise me about the following :
A clear timeline for the processing of my application - permanent solution.
Evidence that a case worker has been allocated to my application and will be available until a decision has been made.
How UKBA and Home Office intend to compensate me for the losses (of money, time and inconvenience) it has caused me and my family.

Visas held for 10 years: 5 years student (1 year computer course+bachelors), 1 year IGS, 1 year PSW, 1 year student (MSc), 3 years student (PhD) with visa expiring October 2013. No more of 3 months out of the country in total.

Also, in my complaint letter I asked if I could apply for the British passport in October hence HO took ages to process my documents....they did not answer, they only said my documents have been processed already and on their way.

I think I will just wait the year they ask, unless I get written proof from someone at HO that I can.

For all the ones waiting, specially June/July and August applicants, please do complain. Do make your MP's aware as even when they do nothing, it creates awareness about the issue.

If any member has official statistics about recent processing times of the set(O) applications and (of those applications) 10 year residence applications, please post. I would love to see them.

Does anyone also have official documents about what constitutes "compassionate or compelling" cases? The sentence about the compassionate and compelling cases was included in the guideline probably to create some room for interpretation and to give some flexibility/autonomy to caseworkers. Probably, it is not defined for those reasons. But I am just curious if they have official definitions about those terminologies.

i want to move to a different city, i am wondering if i change my address

1. would it effect my application(timing wise).
2. Are UKBA efficient enough to change it accordingly ? as i don't want to move to a new address and findout UKBA are still sending my corespondence to my previous address ....

I have applied for ILR on 10 years legal residency in August 2012 and I haven't recieved any result. My wife is living with me since 2009 and her Tier4 dependent visa and our child who was born here is going to expire by the end of this month. I am going to apply for her extension by post.
Is FLR M the correct form for her to apply?
In section 12c do I need to show the documents for two years that we lived together or it only applies to unmarried partners? if yes do these documents need to cover the whole 2 years period.

I need help in filling the flr m form. My wife can to uk on psw dependent in early April 2012. she spend 1 year on psw dependent .

My application is pending on 10 years ILR and my wife's visa is due to expire in end mayl.

I my previous discussion on this form i was told that she falls under old rules. and i don't need to fill the section 7A and need to go to section 7B

Help on the Form

Setion 2 : I have selected spouse of a person present and settled in the uk and a biometric immigration document. (is this correct?)

She is applying flr m for the first time but she is already a dependent. what should i say yes or no?

In the same section they have a option which says if you are applying for any other reason - please explain below (on page 7) and there is a box to fill in. Do i fill in this box with the details of my ilr pending??

Section 3 point 3.15 "if your sponsor was not british from birth, when did your sponsor obtain settlement? asking for a date what should I say? my application is under consideration for ILR?


In Section 4 (it says it is mandatory to complete this section as required. )

Do we need to fill in any of this even if there are no children applying ?
My wife is expecting any day. What if i am applying her visa after her delivery do i need to fill in this section.

Section 7A: do i need to fill in any of this including 7.1 question? or should i just go to section 7B?

If we fall under old rules i have seen on one of the links on this forum that you have to have 111.45 per week for a couple without children + the rent and the council tax. How much salary is sufficient for the flr m under old rules

do they consider any bank balance(s) in flr m application.

In this section include any children under the age of 18 who are living with you in the UK and who are applying as your dependants. It is mandatory to complete this section as required.


Even if your wife gives birth to your child, you don't have to worry as you aren't including him/her in the application. 4.1, 4.2, 4.3 should be No and proceed to Section 5.

Note: this is not correct and you fall under new rule and I am afraid to say you have to fill section 7A and meet £18600 Financial requrements.
As we have been to the sheffield PEO yesterday ...I will write my yesterday experience on this forum shortly...so this could be helpfull for other members ....
