As i mentioned last week that i have written to a few people Rob Whitemen, Teresa May and my MP Bob and got responses from all of them apart from Teresa May. Finally she wrote today as well in a form of an email with a PDF attachment and here is goes.

I refer to your email of 19 April to the Right Honourable Theresa May, regarding your application for Indefinite Leave to Remain (ILR). Your enquiry has been passed to me to respond.
We received your application for ILR on 6 September 2012. Our published service standards are that we aim to decide 95% of postal applications within six months and 90% of applications made in person at a Public Enquiry Office within 24 hours. Each case is considered on its own merit and we make a decision about whether or not an applicant qualifies for settlement in the UK on the basis of the information about their circumstances that they have already provided and any new information which they may submit with the application form.
Enquiries into applications for ILR are extensive and varied and can sometimes take longer than anticipated to complete. Some of the enquiries are completed by external agencies on our behalf. I am sorry that it took longer than our average waiting time to process your application, some applications may take longer, depending on the nature of the enquiries to be carried out.

So finally my ILR has been approved 9th May. I applied on 6th Sep. Bio done on 11th Nov. Email send to expedite on 18th April.

Application approval

Hi Guys,

I have now received my BRP and passport and have added on skydrive.
Application sent: 28/09/2012
Acknowledgement letter: 01/10/2012
Biometric enrollment:08/12/2012
BRP Approved:07/05/2013
Passport returned: 10/05/2013

Just to add, my partner also applied on same day as me and we enrolled biometrics same day but she received her documents around the 28th of March. There is no pattern at all, so never feel distressed someone has received their papers when you applied same time or they applied after you.

Hi All,
I was been away for some time. Now came to share good news with all of u specially Damanishallo and Sanju. My ILR Set(M) has been approved within a month. It was unexpectidly quick process as compared to my previous application with 7 months wait. Many thanks to Damanishallo for instant advice that day to add some clauses and words in cover letter. I think that letter and mentioned rules played an important role in this quick process of approval. and thanks Sanju for keeping our morale high. Though for us it was a long, tiring, tense and double money consumption period. But eventually it turned out well and we almost forgot our past bad experiences. Thank you all again for advice and encouragement. This blog helped me alot, more than a lawyer. This blog was a blessing for us in this hard time. Wish all of those who are waiting best of luck and keep faith. My timeline is for Set(M) but just for an idea that things are moving quicker now as compared to last year.

Applied by Post = 5th April 2013
Approval Letter = 11 May 2013
BPR Recieved = Scheduled for 13 May 2013. Missed a DX delivery on 10May 2013.

Can any one help me with my queries please.
I got ILR on 10 years long residency and have applied for my wife and my daughter who was born here on FLR M by post.when i was posting this form the same day i received my ILR approval letter which I have attached with the form.

My first question is do i need to send my original passport and bio metric card to support this application? or can i send the photocopies.

Second question is my wife has been living with me since June ,2009 in the UK. After her extension approval on FLRM will she be eligible for ILR as she has spend 3 years on Tier 4 dependent?

There is no definite verse mentioned anywhere. There have been instances where members have received their partners approvals even before sending the main applicants BRP/Passport. In your case, you've already sent them your approval letter, which I presume should serve the purpose. You can always ring them and seek for further assistance.

Second question is my wife has been living with me since June ,2009 in the UK. After her extension approval on FLRM will she be eligible for ILR as she has spend 3 years on Tier 4 dependent?

For sure she'll be considered under the old rules in terms of Financial Requirement. However, it depends on what date she's applied for her FLR(M), If she's pre 6th April 2013 [For SET(M)] then she should be fine. However, if this is not the case, then she'll have to spend 2 yrs before she can apply for her ILR as she's been a dependant on a route which does not leads to Settlement. - HTH

Hi Damanisshallo could you pls tell me in which way student dependant who applied before 6 April can qualify for ilr straightway? I remember I raised this issue before n your reply was not positive. This will help me a lot if you kindly show me the path as my wife's flm still waiting to be approved which I applied in oct 2012 thanks.

I think I typed it wrong, I meant, one should've applied for SET(M) before 6th April (a la Nats) to be considered under 2 Yr qualifying period irrespective of whether you are on a route to settlement or not.

6week shortfall

Hi all,
I humbly request if Damanisshallo or any other members could advise me regarding my case, i have asked about my case before but still very confuse . I hope u all cud understnad that how difficult immigration rules nw a days , and i just wanted to make sure that i choose right option at right time.
Actually my visa (psw) finishing(oct 2013) 6 week before my 10 year stay completion and i dont fall in any other cataogry so getting extension is not an option for me.
My question is

1) should i apply using set flr(o)private life(2 days b4 my current visa expires) , just to cover shortfall
2)or can i apply Set(LR) with 6 week shortfall , i asked someone who knows a bit about rules and he said i cant make Set(lr) before completing the qualifying time. Is it true?
3)For instance If i send flr(o) do i still have to wait until i complete my 6 week time or can i vary grounds of my application 28 days before my qualifying time?
Also can i send my wife application with flr(o) if yes then which form i should use for her , she is here since 2009 as my dependant(tier4 first and then pbs dep) her visa expiring the same time as mine
Guys plz guide me regarding above
Plz give us ur input if u think there could b any other better option for me

Yes, because FLR(LR) doesn't applies to you.

I am confused with this question as I can clearly see the provision for dependants on FLR(O). Why would you want to send a separate application?

But once she gets her extension on FLR M , the date she applied wont be written on her biometric card so how she will be be differentiated by pre 6th April application .can you please tell me which form is used for settlement after FLRM?

You might need to save her acknowledgement letter to prove this or request a SAR from UKBA which should have her historic data.

can you please tell me which form is used for settlement after FLRM?

Hi everyone,

Just to update my timeline - I have now received my BRP and passport; the details of the timeline are as follows:

Application sent: 08/10/2012
Acknowledgement letter: 20/10/2012
Biometric enrolled: 26/11/2012
BRP issues: 07/05/2013
BPR received: 09/05/2013
Passport and other docs received: 09/05/2013

I've added the details on skydrive file. My application was fairly straightforward and I did not use a solicitor.

I'd have thought so. However, I am wondering why would you do so.

i was saying only because of this
Applications received 28 days or less before the required qualifying period is completed
You can grant if an application if it is received 28 days or less before the applicant completes the required qualifying period, provided they meet all the other rules for long residence

(also i thought there was provision in LR guide that 28 days of overstay can be disredarded , all my previous applications were in time and never overstayed )(i have checked in SAR)

i didnt know that i can add my wife on to my FLR(O) application :?sorry
if i add my dependant with my FLR(o) is that mean(by the end of november ) when i vary my application i have to vary her application as well , will it be flr(M)

i think from above i can relate my case in 276ADE(vi) as i dont have many close family members back home, my brothers are present and settle in Uk with thier famlies.since 2003 only been back home, a total number of days spend there about 90days (do u thnk is it enough reason to put up FLR(O)?
finally is FLR(O) for me the right choice?

Hello Experts,

I'm currently in the UK as a PBS Dependant under my partner's Tier 1 General Category valid until 2016.

I would be eligible for ILR on my own under the 10 yr long residence rules later this year. My partner would like to switch to ILR Dependant under me by applying for the visa outside the UK once I receive my ILR. She is currently employed full-time in the UK and earns a salary above £18,600.

Now, can she show her own salary of £18,600 earned in the UK (while under Tier 1 General category) to fulfill the financial requirements of the ILR Dependant visa application to be made outside the UK?

Or, would my salary alone would be considered for her initial ILR Dependant visa application?

Any help would be highly appreciated.

1. Does your salary meet the criteria. If "yes" then its great if not, I think it is better she apply from inside UK if its possible.

2. Why apply outside the UK. when she got Visa till 2016

3. Is her Tier 1 general and extension or an initial grant. If "Extension", she is going to qualify for ILR in 2016.

But if she changes to ILR dependent she may have to wait 5 more years from the date the dependent visa is granted ( i mean that's if these rules haven't changed by that time - which I think they will more likely)

I know if she is not earning enough salary then it could be a problem, but you have to think about this carefully

My wife is eligible for her ILR from May 9th... but god it's taking my toll to make her read the bloody new LIUK book... I mean I can't even blame her.. Why the hell... they need stone age and in depth Tudar's and stuart's UK history.. they are not giving a GCSE exam on history of UK...In my ten and half years life in UK.. being a regular in the local pubs (grabbed every opportunity possible)... I have never seen someone talking about that history shit (only footy)..

I think the new version is so in depth that it can be recommended for people who want to go to the TV show "Who want to be a Millionaire"...

I have been a silent reader for over 7 months now. I had found this forum around the time I wanted to apply for my ILR.

I have now gotten it and I thank God for that. It took a period of over 7 months during which I had written 2 complaints and called and was given a response that they were unable to give me a timescale on when the application would be completed.

My registered post bag was not used so there was no way I could have been able to track my documents.

I have found this forum very useful and encouraging during the wait hence why I want to share my timeline so others can take comfort and know there is hope.

My case was straightforward with no breaks.

Application sent 8th Oct 2012
Received 9th October 2012
Paid via debit card
Acknowledgment letter dated 16th October 2012
Biometrics letter received 24th November 2012.
Biometrics done 24th November 2012
BRP received 10th May 2013
Documents received 13th May 2013.

All I sent in were my passports and pass notification for the test.

Between November and now, I have had to change jobs and moved cities so I did update my correspondence address with the home office online and also did a redirect( I had read somewhere here that someone's address change had not been processed). Everything came through to the new address.

I wish everyone else waiting all the best and pray they get positive answers soon.
