i asked few question to home office,

Dear Home Office,

Could you please help and advice me,

I (the Main applicant) have been granted ILR on the basis of ten years long residency and my dependent had a Tier 1 (PSW) status up till 31st July, 2014
My questions are,

1- Do I need to show (18,600) income threshold for her FLR (M) visa as she came very first time on student dependent in UK in March 2006?

2- After switching to FLR (M), can she apply for ILR immediately as she already had spent two years as a dependent? And will the years spent on PBS dependent (Student and PSW) granted entry clearance on prior to July 2012 rules count towards the qualifying period?

3- Could you please mention the immigration rules to substantiate your reply?

Dear Mr ---------

Thank you for your email dated 24 June 2013. Your enquiry has been forwarded to Home Office Public Enquiries because it is not a policy enquiry.

Please be advised that if your dependant was granted a Tier 1 (PSW) dependant visa prior to the 9th July 2012, she may apply for a spouse Leave to Remain under the rules in place for Partners who applied on or before 8 July 2012 and would not need to show the £18,600 financial requirement.
If your dependant has also completed two years in the Uk as a Tier 1(PSW) dependant, she can also apply for settlement after she gets her spouse under paragraph 284 (b) of the rules. Please be advised that time spent as student dependant is excluded.

I first entered on the 18th August 2003, current visa expire on the 19th September 2013. So can I apply on the 21st July (4 weeks before the 18th August)?

Lawful residence is defined in paragraph 276A of the Immigration Rules as a period of continuous residence as long as you got valid visa so you can apply before 28 days prior to your application time.

In my calculation, earliest you can apply 22 July as July is 31 days. If I was you I would apply at least couple of days later; just to be in safe side.

Can someone please clear my confusion... My wife came with me in Jan2006 as student dependant...

in Oct 2008 we got PSW for 2 years... which was points based system....

in Nov 2010 I got DLR for 3 years...

and in June 2013 I got ILR on the basis of 10 years...

will she not come under old spouse visa rules because she has already spent 2 years on PBS from 2008 - 2010

Please see the paragraph below which I took from the following url:
A partner, child or adult dependent relative who has been granted, or who has applied
for, leave to enter or remain in the UK on the family route (or a partner of a migrant with
leave under the Points Based System) before 9 July 2012 will remain subject to the rules
in force prior to that date. They will be able to reach settlement in the UK (including those
granted or who have applied for leave as a fiancé(e) or proposed civil partner) if they
qualify for it under the rules in force prior to 9 July 2012, subject to the requirement from
October 2013 to pass the Life in the UK test and to present an English language
speaking and listening qualification at B1 level or above to qualify for settlement.

Hi All,
I need Help Please.
Please correct me if i am wrong.

1. To my understanding to register a british born child under 18 one of the parent should be in ILR. Is that correct?

My case
1 . I got recently 10 years ILR
2. My wife is in Tier 1 General Visa till Sep 2013.
3. We have a 2.5 year old kid who was born here.

Can i register my kid as a British citizen using MN1.

It 's all about luck.Some lucky applicants got ILR lately who applied after some of us.Congrats to them.It's heart breaking though.Patience is a virtue.

By the Grace of Allah SWT i got my ILR. The timeline has been updated on the sky drive.

I thank you all for your support in these tough time which i went through. I pray for all the others to get their visas' sooon Inshallah.

I applied on 07th Jan 2013.
the visa is issued on 20 June 2013.

Those who are waiting from last year don't loose hope its going to come soon inshallah.
