Dear MAT1055,

yes its matter , they will not issue you visa or biometric card on your expired passport , LR application are taking minimum 6 months so better apply for the renewal of passport and then apply !

Hi guys
I've been a silent reader dying inside to see if anybody will ever post any situation like mine. Basically here is my story
Arrived August 2003 as student 2004 visa renewal refused was a college mistake on my attendance stupidly and not have knowledge I didn't appeal I decided to send new application fresh....HO came refused that too saying I didn't use my right to appeal. I started learning to use solicitors which they eventually re apply my right of appeal this now goes to 2005 me not having my docs back or knowing what my status is. The HO then went quiet no response whatsoever but once in a while my solicitors would chase them and ask what's going on...still no response...after every so often I would send a letter from my college saying what I study where I live and attendence too....these letters would go to my solicitor trying to push to the HO to tell what im doing.
They send me letter on the old address that mentioned I need to be reporting to their centre every monday I didn't receive this letter or my solicitor as I was already moved to different city studying, so when my solicitor chase he then realised there was that letter anyway he told them about my new address college etc if I can report to any of the nearest onea. They went quiet again, then eventually 2008/09 contacted my solicitors asking where I am and need to put I words what I have been doing in the country so I wrote my history
Then forward all my certificates attained since I came here
They eventually gave me my passport with a student visa in it
So 2004-2009 they had my stuff without me knowing whats going on.
2010 I then got a psw visa which expired 2012 dec
Dec2012 I apply to be my wifes dependant and march 2013 got rejected that I cannot apply inside the country.
I appealed and my hearing was set to august 2013 two days after I reached 10yrs in the country
I went for the appeal and three weeks later the judge dismissed it this is when I decided to send my 10yrs set lr
My question is: whats my status on 2004-2009
Will it count towars my ten years LAWFULLY residence considered all the dramas I had but they eventually gave me a visa 2009?
What re my chances on the set lr?
I have done biometric and dying inside
As far as I'm concerned my 2013 appeal dismissal might not be a big deal as they law used is no longer in force

Skydrive only represents just under 1% of total or much lesser Long Residence applications (10 Years). For this year alone Home office (HO) received 3,340 Long Residence application (10 Years). This means one should not assume speed of processing based on Skydrive Excel sheet solely. Skydrive Excel sheet shows some pattern of processing.

See this Freedom of Information (FOI) request I obtained over month ago that explains clearly how many applications HO is currently dealing with but processing much quicker than the year 2012.

I am new on this forum. I like to add my experince on this forum.

I got my ILR on the 10 year basis in Nov-2011. Then I become British Citizen in Jan-2013. My Wife Applied for spouse visa in 2011 but was given Discretionary Leave for 3 years. In the Meanwhile my wife got eligible to apply for ILR on the basis of 10 years contineous lawfull resience in April 2013. Then she applied for ILR as follows:

Application Sent on: 21-May-2013
Acknowledgement: 23-May-2013
Bio- Letter received: 05-June-2013
Biometric Done on: 06-June-2013
Approval Letter/Passport: Waiting

I have finally received my long-waited IRL permit.
I would like to share with you the timeline of the process.

Application sent: 29th May 2013
Biometrics Invitation: 13th June 2013
Biometrics Done: 24th June 2013
Passport received: 23rd October 2013
IRL permit received: 24th October 2013

My wife apllied for FLR (M) after i got ILR but she was given discretionary. She couldn't apply for ILR Dependent visa bcz she did not completed 2 years on Tier-1 dependent before she applied. After I got ILR HO said she needs to apply for ILR Dependent asap because her status had changed.

I hope this info will help someone.

I applied for my ILR SET(LR) on July 12 and had biometric done on July 29. When I got back from work on Friday, I got a letter from DX saying that they tried to deliver a package but I wasn't home. I have now rescheduled for it to be delivered early next week. But typically, I'm concerned because I haven't got any confirmation letter from UKBA or my passport + other docs.

Could this be my ILR BRP or my previous BRP (tier 2)?

Hello Experts,
My 10 years completed in this country last week, and I was intending to apply for ILR on 10 years lawful residence. In my 10 years once I had worked full time ie signed permanent contract in professional company and was caught at the airport by IO, then I challenged their decision, which I won after 8 months and granted LTR.

I have asked couple of people solicitors/barristers etc, they said, that its upto you, and a bit risky ie if you say yes in the application form that you worked full time then IO can apply deception section and can refuse your application with no right of appeal, if you say no then they have a record of your IO interview at that time and signature etc and can refuse again that you provided false information etc. Also chances are they IO can revoke/curtail your existing leave to remain and will handover right of appeal, which will eventually effect your employment/private life, as these IO's don't care about foreigners private life/employment etc.

Solicitors said, apply on 5 years Tier 1 Gen category in premium services, which will be points based and much quicker. which is 18 months away from now.


Any suggestions ?

Have you got straightforward case or clear immigration history? If yes, then likely it will be your Biometric card for permanent residence or ILR. The reason I am saying because according my calculation, straightforward 10 years long residence cases are processing on average in 3.5 months. This calculation I made by calculating average processing time based on the information I obtained on the basis of Freedom of Information (FOI) act response on 10 year Long residence applications.

Please post the status once you received the re-delivery.

Most probably it is ILR and everything is fine, but regarding to calculation of 3.5 months for straightforward cases, this is not correct. This is very much like a lottery. If you want more certain statistics, it was done. There was a guy here recently, Johny Dhaka, I believe.

He is an accountant, he analysed Sky Drive for one year. Here it is. In commas, I put approximate possibility of getting ILR in percentage. This is very rough guide but it is nowhere near 3.5 months anyway. It is easy to see that people with very straightforward cases usually wait longer than 3.5 months, but this is very much a lottery. You can wait 10 weeks or 26, no direct link with the complication of your case. Some people with questionable gaps waited for only 12 weeks and vice versa. Here it goes:
2 person got ILR in 10 weeks, (6%)
2 person got ILR in 12 weeks, (12%)
1 person got ILR in 14 weeks, (15%)
1 person got ILR in 17 weeks, (18%)
1 person got ILR in 18 weeks, (21)
5 person got ILR in 19 weeks, (36)
8 person got ILR in 20 weeks. (60)
4 person got ILR in 21 weeks (72)
3 person got ILR in 22 weeks (81)
4 person got ILR in 23 weeks (93)
1 person got ILR in 24 weeks (96)
1 person got ILR in 26 weeks (99)
If you would say that it takes 3.5 half months for straightforward cases, people would worry why the hell they still did not get ILR, what's wrong with them. They should not feel this way after only 3.5 months. I know you meant to help but look at this forum and Skydrive and you will see it is never near 3.5 months in most cases and most cases are straightforward.

I just wanted to stress again that your Excel sheet only represent less than 1% cases of 10 years Long residence cases. The excel sheet data can't be used for coming out with good conclusions due to less than 1% of total Long residence cases in that sheet (I am sorry this is a fact!). This is a reason I opt in for scientific approach and used Freedom of Information (FOI) request. My calculation is based on recent Freedom of Information (FOI) request obtained last month for total 10 years LR 2013 and 2012 pending applications. Here is the FOI reply link.

Also I use the word "average" 3.5 months. It could be bit "lesser" or "greater" too but on "average" it is coming out as 3.5 months with the current rate of processing of application for the year 2013 and backlog of the year 2012. For straightforward cases deal usually by junior case worker and doesn't require senior case worker input it usually process quickly or based on this data much quicker.

For your information I am also obtaining few more FOI request to paint a good picture of immigration application processing time, pending applications etc so I will the push authorities to speed up the processing rate. Believe me I don't rely on Skydrive :) but I must say it is helpful for getting some sense of basic understanding.

4 person got ILR in 21 weeks (72)
3 person got ILR in 22 weeks (81)
4 person got ILR in 23 weeks (93)
1 person got ILR in 24 weeks (96)
1 person got ILR in 26 weeks (99)
If you would say that it takes 3.5 half months for straightforward cases, people would worry why the hell they still did not get ILR, what's wrong with them. They should not feel this way after only 3.5 months. I know you meant to help but look at this forum and Skydrive and you will see it is never near 3.5 months in most cases and most cases are straightforward.

From the excel file,

We know they are working on the Month of May applicants.

May applicants if you got ILR ,please update us.

Out of 12 , 8 already completed.

Yea, it would be very nice to update us. If someone from May is still waiting, please let us know anyway. It looks like some people forget to update us. Cheers.
