Post by SKV » Mon Jan 13, 2014 10:03 am

Hello,

Can anyone advise?

I have sent my application on 17/09/2013. Biometrics done 08/10/2013.

My situation, I was 7 years as a student, 2 years post study work and 1 year as unmarried partner of an EEA national. Current visa expires 17/09/2017.

I have provided different documents however I did not provide evidence that my Partner is currently exercising treaty rights. I only attached a letter from him confirming our relationship and a certified copy of his passport. As we applied for my unmarried visa not long ago I suspect the home office knows he is exercising treaty rights??

My question is, would they request evidence if they need to know he is exercising his treaty rights or would they just refuse cos i did not provide all the documents I should have.

It is been nearly 4 months so I am getting a bit anxious and thinking all sort of negative outcomes hehe.

Thanks to all.

It is soon going to be 10 years since I have lived in the United Kingdom, and I wish to find out if I am eligible for Indefinite Leave to Remain,

All my visa extensions have been well in advance of their expiry except one,

where my first student visa expired on 13/07/2005 and I posted my student visa application two days later on 15/07/2005 as especial next day delivery and confirmation of receipt of my application was issued on 28/07/2005 and student visa was issued on 16/08/2005,

It seems there is 14 days gap including weekends between my visa expiry and receipt of visa application was issued at stated on home office letter head,

And application was post after 2 days after visa expired the reason for this was that my college released my documents late on 15/05/2005, dates also stated on my college documents,

In my 10 years stay in UK, I have only once been out of UK for one month exactly,

I would be very grateful, if you could access my situation and confirm if I am eligible for ILR application,

Hi there as for i know your Gap is going to counted the day your visa was expired and your next visa grant so its going to be between 13/07/2005 and 16/08/2005 which are more then 28 days ,because if you apply after your visa expiry you are not covered by 3c, if this the case you need to get good legal advice from a reputable immigration lawyer and getting letter from your college why they issued you papers late any way you could have send your application without those papers and send them later.
Still many people got ILR even having longer gaps in their long residency the only thing you need to try it.

Hi Need Advise,

I have applied for SET(LR) on 11.11.2013 and received acknoweldgement on 13.11.2013.

I got Bio Metric Letter on 31.12.2013 but my nationality was incorrect, so i reported on 02.01.2014.

when i reported, I been told by HO officer that ignore the previous letter as we will send you an updated one.

As i have not received yet so i called HO today 13.01.2014, to my surprise HO officer today i cant find anything...

after a long discussion and taking my other details he told me that some1 has deleted the application and he read the note on the account.

after few mins he said, it seems like due to incorrect nationality they have to delete the application and re-enter again....

so Friday(10.01.2014) it was deleted, hopefully within a week they will re-enter it again....

so, i ask him what should i do ? he simple said : Wait till you hear from us....

Its been more than 2 months money gone from my account still no Bio Metric Letter ?

I dont know what should i do ? any advise ?

Regards

Sadiq

Do they use normal postage or special delivery when delivering your decision?

As I have spoken to HO, there is huge backlog due to new rule change after October, so we are going to be very lucky if we receive any result in 6 months.

hi all,

as i got ILR on 10 years base.and i have couple of questions.
1. my wife and my daughter(Born outside uk) are in uk and my dependent since 2007 and my visa was tier 1 general in 2007 now ILR.
2. i have son born here in 2013 while my status was tier 1 general.

now i got ilr and i need to apply for them as i understand from this forum if i go to the PEO appointment i can get ILR if apply through set M rather then swithcing to flr M. if so what is percentage of getting it and if so why not in post i can get ilr.

second my son will apply using MN1 as now a days long process for that can i apply for him set M and get ilr as well or i can only apply MN1.

thankx for help in advance.

I am in shock, I posted only a few days ago to be put in skydrive expecting to get letter end of Feb at earliest but am happy to report I got my approval letter Saturday 09th January (but was not home to receive it so only collected it today). Thank God and thank you for this wonderful board and the support here. Wishing everyone else the best.

Please update the skydrive:

Application sent: 3rd October 2013
Acknowledgement Letter: 7th October 2013
Biometics Letter: 22nd October 2013
Biometrics done: 25th October 2013
Approval Letter and Passports: 9th January 2014
BRP: Waiting

I have to say that I sent them two extra letters post application. One to explain I had travel plans in December and January (for holiday) which were ignored. I then have an urgent work trip end of January and so my employer sent a letter and faxes asking for expediting the process, I also called the case worker to ask for expediting. They never said they would expedite it. So I am not sure if this is just the natural processing time it would have taken anyway.

They will only use special delivery if you provided a special delivery envelope with your application. Otherwise they just send it signed for.

Hi the numbers I used were: 0870 336 9405 and 0151-213-2910 and an email was also sent to SettlementOpspolicy@homeoffice.gsi.gov.uk. Concrete proof of business trip and arrangements were sent through.

If absence is more than 180 days at any time, HO considers lawful residence is broken unless you provide them with very good reason for absence.
