Tool for 180 day Continuous stay calculation

Post by marcnath » Sun Apr 08, 2018 10:02 am

The Jan 2018 changes in immigration rules revised how the 180 day absence was calculated.
This has made it complex for applicants to determine if they are compliant with the 180 day absence.
I create an excel sheet to try and help determine if an applicant would violate the 180 day absence.
You can find it at https://1drv.ms/x/s!Aq7gSza4ER7CmP01mJt0s9dX8ontdQ
Instructions to use it are in the file itself.
Essentially, you enter the travel dates (you need a password which is included in the file) and where there is a problem, a red NOK will show up.
I have tried to check different scenarios and it works in most cases.
But it is not perfect - it does show NOK in small cases when it is actually ok - so you should double check the result.
I welcome further feedback on how useful it is and any errors that you can spot.
My comments are in no way meant to be advisory. I have no professional knowledge of immigration. These are based on my own experience, convictions and personal interpretation of publicly available information.

Dear Marcnath,

This tool looks good and may help me to calculate my absence for more than 180 days in any 12 months. I saved this in my computer but its password protected. What password you are referring to included in the sheet? Please advise.

Cheers

When you try to enter the dates, it should ask for a password. The password ("unlock") is in the instructions at the bottom of the sheet.

Your date format is showing MM/DD/YYYY. whereas in the file it looks like DD/MM/YYYY. Maybe I have missed something, Marcnath could confirm.

Not sure what you mean by half the information - if you are talking about some blank cells in the top rows that is as expected.

But, as you said, it does not show any NOK, so that should mean you are ok. And looking at your travel manually, yes it is ok

Sorry, I may have confused you. I mean in column F (Travel Days) it calculates upto 4 rows only, however, I have 8 rows to fill and therefore not getting for the last 4 travel dates.

That is also as designed - once it crosses 180 days, the tool does not calculate any further but just checks that the 180 days is not within 12 months. Column H then calculates for the next set of travel and so on.

Hi Marcnath,
As regards T1E dependent, I understand from below from their guide that my dependent's absences before January 2018 will not be counted, is this true? Me & my wife got T1E visa on 5/09/12, entered UK on 21/9/12
and got extension on 17/11/16
PBS dependants
You must not include any absence from the UK during periods of leave granted
under the Rules in place before 11 January 2018 towards the 180 days allowable
absences. For example, if a dependant’s qualifying period includes initial leave
granted from 1 January 2015 to 31 December 2017, and an extension granted from
1 January 2018 to 31 December 2019, you must not count any absences before 1
January 2018.

Correct. You got quite close - 177 days.. but not 180. If you had left on the 7th Feb 2015 instead of 23rd Feb, you would not have met the requirement.

Hi Marcnath,

Thanks for this great tool. Can you please clarify Under tier 1E route total absence in each one year is 180 days? which is for 5 years 900 days ? or is total 180 days for complete 5 years to qualify for ILR.

And what about 10 years long residence , which is according to my knowledge is total 18 months(540 days) and each year no more than 180 days absence.
My scenario is as under

mm/yyyy---- mm/yy-------Absence
09/2009-----10/2009--------26
11/2011-----12/2011 -------33
10/2012-----12/2012 -------65
04/2015-----05/2015 -------31
07/2015-----10/2015--------77
04/2016-----07/2016--------82
11/2016-----02/2017 -------92
07/2017----- 07/2017--------5
12/2017-----02/2018 --------74
Total ======485 days

Total absence is 485 days in 9.5 years
Total absence during Tier 1E is 361 days

Please let me know if i am ok Under both scenarios ( 5 year ilr n 10 Year Ilr)

Many thanks

It is neither of those. It is just 180 days in ANY 12 month period, so there is no total absence.

Hi

Your program is great.

Could you have a look at my travels? Obviously it says NOK.
If the calcuation would be from 28.11.13 to 28.11.14 is it less than 180 days, but your program looks like calculating from 28.11.13 to 31.11.14. Could you advise how HO would calculate with the revised rule please?

18.9.13 4.10.13
16.10.13 22.10.13
28.11.13 17.12.13 <<
12.1.14 28.1.14
19.2.14 7.3.14
31.3.14 18.4.14
14.5.14 12.6.14
9.7.14 29.7.14
23.8.14 17.9.14
10.10.14 29.10.14
27.11.14 31.12.14<<

You are right.
As I had mentioned, it is not perfect but meant to help make your assessment.
So, the NOK is more of a risk pointer.

Your travel pattern will help me improve it, but you seem to be ok. Your worst case is possibly between 16.12.13 and 15.12.14 where you get to about 150 days of travel.
