180 day rule for ILR

Yes, can get a letter from HR on business letterhead..


1. So you think I will be okay and no need to reduce my holiday period, everything is now included till I apply?

Two more queries:

2.Since the form doesnt ask for us to calculate days of leave, should I just fill in the dates?

3. Date on passport on entry to India is sometime a day late due to time change and reaching after midnight is that okay?

Yes, I did include all dates of my absences, with brief explanation for each.
Anyway, the HO can find this from the UK entry stamps, and your country exit stamps in your passport. It is safer to include all your dates, even if they are not clear in your passport.
My holidays will come up close to 190 days in 5 yr period, and I was seriously considering reducing my forthcoming 15 days trip before applying for ILR.
If your trip is not a paid holiday or family reason, it would be better to reduce or cancel it.
If you have any paid holidays or, any family reason (attending marriage, funural, etc), I think the HO will take this into account.

how we can prove paid holiday ? through payslip of that time ? or bank statement of that time. As we have to submit only 3 months bankstatament and payslips ? do we need to submit those payslips/bankstatment as well ?

My absences excluding travel days are coming to: 171 d, plus 17 d of official study leave.
I plan to add detail like Conference name and venue for study leave letter, as it may make the case worker's job easier.

I have a gap of 136 days (11 Apr 2006- 24 Aug 2006).I have the salary slip for month of Apr 2006 and I have worked in above duration from india. I don't have chance to get the employer letter.

Any thoughts what can I do to present my situation ? Please help

Hi,
You may want to consult an immigration lawyer as your absence without being paid in UK means you have a break of residence.

I HAD 355 DAYS OUT OF THE COUNTRY

Please help me ?

I had 355 days in total in my 9 years and 5 months.My 10 year going to complete in Sep2011.

I wonder its will effect my ILR ON 1O YEARS?

Can I reduce my last 3 visits 25,46 and 27 days as declare as Business trips?

My understanding is that if you apply for ILR and do not qualify that it is converted to an application for extension. See caseworker's manual for confirmation. It would be prudent to provide the documentation that satisfies the criteria for extension with your ILR application.

Can you please point out the case worker manual where it say that if you apply for ILR and do not qualify that it is converted to an application for extension.

Please if someone has come across the above statement please let us know.

I want to know more on My understanding is that if you apply for ILR and do not qualify that it is converted to an application for extension. See caseworker's manual for confirmation

Please can someone put out the case workers manual.

Hi all,

Can you please advise me with the following.

I have been away from the UK for a total of 192 days during the last 5 years. This included a holiday abroad, which was supposed to last a week, but carried on for 4 weeks, as I spent 3 weeks in a hospital (abroad) with a foot injury.

Would these 3 weeks be deductable from the 192 days?

And if yes - what sort of documentation would i need to provide?

I'm not sure what category you are applying under, but the caseworker guidelines for ILR (UK Ancestry) advise the caseworker:

"You may use discretion if there have been significant absences abroad and they were:
• compelling ones of a compassionate nature, or
• to do with the applicant’s employment or business in the UK."

See page 20, 'Indefinite Leave Qualifying Period' of the UK Ancestry Guidance 28 March 2011.

I am assuming this is the most current one but sure someone will correct me if it isn't. I am not an expert and don't know whether this applies to other categories too.

Have you excluded the travel days from the total 192? That doesn't count in absences.
