Absence Letter for Remote/Annual Leaves

Hello All,
I would be recently going to start with my ILR application process.
Do we need the Absence letter from my employer ? I got married in 2021 so I was away for around 3 months to India and I worked remotely most of the time.

Please advice. Thanks

Hello Zimba,

So, to confirm:
1) No letter whatsoever is required ?
2) My maximum days outside in UK are 163 days. Can I provide salary slips and bank statement for any evidence ?

1) There is no specific evidence needed. The letter simply can say that all your absences from work were approved by them

1) I can't seem to reach my previous employer. Do I need a letter from them ?
2) Any other home office publications which is applicable to the letter of absence scenario which I can read ?

Great. Thanks for your response.

I just got the letter from my company HR stating - "In addition, we confirm that all of XXXX absences, both business and personal, have been in line with his/her employment contract".

So, in a nutshell, I have the employer letter where they have this section mentioned.

I think this should suffice. Zimba ?

Hi Zimba. A quick question on English language proficiency test. I have the NARIC certificate from my first application. Can I produce that instead of an Ecctis certificate(which I assume is a new UK specific version of previously what was called NARIC) ? Thanks

NARIC is the old name. It is enough

1) One more question, my current skilled worker visa expires in 2024 (along with my wife). If I continue with my ILR application right now, what will happen to my partner's visa (as she is not eligible for ILR because she will be completing 5 years in 2025 and her current Skilled Dependent Visa is valid till May 2024). Do I need to do anything for my partner's visa ?

2) Btw, just wondering, if there is any review service provided by immigrationboards. I will be really glad to get my application verified end-to-end for peace of mind.

1. Nothing happens to her visa. It remains valid and nothing you need to do other than apply for a 3 year extension nearer to expiry date.

2. Other than the forum posts and free advice, no there is not. Immigration boards is just an Internet forum hosted by Work Permit.com

One additional question I have is on 28 days application time. My first T2G visa issuance date on my vignette is 5 June 2017, but I arrived on on 19th June 2017. Can I apply after 8 May 2017 (5 June 2017 -28 days) ??

Secondly, will the above period - between first visa issuance date(5 June 2017) on vignette and entry in UK(19th June 2017) will count as absence from UK and need to be mentioned in ILR application under Immigration History section ?

This is it: 5 June 2017 + 5 years - 28 days
The gap between issue and arrival will count as absence

Hi Gurus - @Zimba/@vinny/@CR001,

Would there be any harm if I provide all of my salary slips and bank statement for past 5 years with my ILR application as an evidence for my absences mentioned below. The reason I am providing them is I have been out of UK 8 times:

Details:
1) 3 Mar 2018 - 8 Apr 2018 - 35 days
2) 14 Sep 2018 - 20 Sep 2018 - 5 days
3) 12 Oct 2018 - 18 Nov 2018 - 36 days
4) 6 Apr 2019 - 3 Jun 2019 - 57 days
5) 25 Oct 2019 - 9 Dec 2019 - 44 days
6) 20 Jun 2020 - 27 Aug 2020 - 67 days
7) 4 Dec 2020 - 17 Jan 2021 - 43 days
8 ) 6 Aug 2021 - 6 Dec 2021 - 122 days

I utilised my annual leaves + worked remotely for the duration I was outside.

I have got the employer letter from my current employer stating that all leaves were authorised both personal and business.

I used calculator from 3million to check if I have crossed the 180 days boundary but it shows I am alright and the maximum I have been out is for 164 days. ---- Would it be safe to apply for ILR taking into account the above data ?

Do not provide unnecessary documents. They do not need your payslips over the 5 years. Proving tons of irrelevant evidence may have a negative effect on your application as the caseworker may need to go through them all

You are not required to provide such evidence. If you are within the limits then you are ok. Caseworkers follow the rules. If they require extra evidence they'll ask for them

One more question regarding bank statements and payslips, my salary is paid on last Friday of every month and my bank statements gets generated on 25th of every month. So, therefore, salary for 24th June is mentioned in May's statement of 25th May - 24th June and for July will be mentioned in August's statement. What should I do ? Thanks

I have applied for my ILR by submitting the application. I have also made appointment for BRP on 10th Aug.
Just to understand the process, when will my application start processing, is it after I attend Biometric ?

When I check for my continuous residence in 3million calculator, it says I have been outside 164 days is the longest total absence in any 12 month period.

My question being:
1) does the above seems any issue to you ?
2) is there a max threshold for ILR on the number of days you can be out in 5 years ?
