Also, (5) for evidence of travel/ absences, would just letter from employer suffice or do I also need to find and submit flight/stay bookings for last 5 years.

Re: applying for ILR? eligibility, documents questions and new VCAS system

Post by AjPS » Tue Jan 08, 2019 10:54 am

Hi everyone, just to summarise, from all the feedback and answers given to me here (special thanks to @CR001 , @tier11417 , @passat & @secret.simon), I now know the following about my upcoming Tier 2 Gen. to ILR application:
  • filled online form: SET(0)
  • once application and docs are all ready I need to book a appointment using the new UK VCAS service for premium service
  • date 1st entered the UK (for this application): use Oct. 2013 when granted 1st T2 Gen. visa, exclude that previously in UK since 2010 on student visa and later on T1 PSW visa.
  • documents needed: 1) online form, 2) passport, 3) current BRP, 4) 2 photographs, 5) UK degree, 6) Life in the UK test pass certificate, 7) 3 months? bank statements, 8 ) last 1 payslip (or 3?), 9) list of all holidays/ work-related absences from UK for the last 5 years (across my 3 jobs for 2 employers in that time: 2013-2014 for old_employer on T2 Gen., and for current_employer: 2014-2016 on T2 Gen. and 2016-2019 (new position) on new T2 Gen. visa), 10) company letter (listing all absences) from current_employer, 11) company letter from old_employer (for absences in 2013-14, I only had 1 holiday trip in this period outside UK, for 14 days), hope that's fine?, 12) ILR visa fee (£3018.20), 13) address proof (is it needed?)
Some doubts/questions that I still have:
  1. My current CoS (2016-19) is for SOC code 2119, salary: £31.1k but that did rise over the years to £33k (not sure if my current_employer needed to notify UKBA about minor company-wide pay rises that happen every year.
  2. In Oct. 2018, I got a promotion at work that saw the title change from Bioinformatics Scientist to Senior Bioinformatics Scientist and salary rise to nearly £38k. I have spoken to HR today to have them notify UKBA via the online SMS system ASAP about the promotion and mention that it is a promotion to a senior position (within the same job type/description) and core duties remain the same.
  3. I will next contact my old_employer for a letter stating I worked for them from 2012-2014, 1st on PSW and then from late 2013-2014 on a Tier 2 Gen. visa, and confirming, my 1 absence under T2 Gen. in the 2013-14 period. Note: the old_employer is no longer a T2 sponsor (as they no longer have overseas employees), not sure if that affects my case as I no longer work for them?
  4. Also: My 1st T2 Gen. BRP for old_employer was for SOC code 2136, 2nd (for current_employer) was also using SOC code 2136, 3rd/ current one (2016-19) uses SOC code 2119 (PhD level role). I believe I am eligible for ILR salary exemption as my current CoS (for the last 3 years) has been for a PhD level role. However, 2 years before that were a non-PhD role. Is this okay or not?
  5. I finished 5 years on T2 in late Oct. 2018. But after my promotion, new salary will only be reflected in Jan. 2019 payslip and onwards. Should I apply already (with Dec. payslip showing new salary + backdated pay rise and old on Oct./Nov. payslips) or wait until I have 1-3 payslips with new salary as that might mean applying instead in early Feb. or early April? Current T2 is valid until July 2019.
  6. In the online SET(O) form, it only asks for current address, where do I provide details of older addresses? as I moved to my current house in Sept. 2018 only. Should I attach a letter stating my older addresses while under T2 Gen. visas (and provide old rental agreements)?.
  7. Do I need to submit P60, etc. too or not?
  8. When entering my travel outside UK, I am unsure about 1 trip: In 2015 I was travelling to Germany with 2 friends. We checked-in at Gatwick airport and went through immigration too but we later had to miss the flight, and return home, as 1 of my friends was fell (very) sick. My passport has an airport stamp from Gatwick airport but no landing/immigration stamp from Germany as I never flew out and never actually made the trip. Do I need to state and explain this as a trip in the online SET(O) form as well or omit this as I never left the country?
Thanks a lot for the help so far and hoping to learn more about the remaining issues. Thanks.

Hi gurus, I have completed the online form (SET(O): Tier 2 Gen. to ILR) and am now finalising my supporting docs before I book a premium UKVCAS appointment.

Supporting Documents needed (kindly confirm please?) & some questions:
1) online form,
2) passport (should I scan all pages with stamps on them or just front & back?),
3) current T2 Gen. BRP (valid until July 2019),
4) 2 photographs (signed at the back),
5) UK Masters degree (English language evidence),
6) Life in the UK test pass certificate,
7) financial evidence: 90 days UK bank statements (stamped by the bank),
8 ) last 1 payslip, or do we need last 3 payslips?,
9) spreadsheet of all holidays (paid annual leave)/ work-trips for "absences from UK" for the last 5 years (across my 3 jobs for 2 employers in that time: 2013-2014 for old_employer on T2 Gen., and for current_employer: 2014-2016 on T2 Gen. and 2016-2019 (new position) on new T2 Gen. visa),
10) A company letter (verifying all absences) from current_employer and verifying my salary and employment for the forseeable future,
11) company letter from old_employer (for absences in 2013-14, I only had 1 holiday trip in this period outside UK, for 14 days), is this needed?,
12) ILR visa fee (£3018.20),
13) what document is needed?, for address proof for current and/or older addresses?[/list]

Remaining queries (please help):
  1. Salary exemption for SOC code: My 1st T2 COS (2013-14, old_employer) was for SOC code 2136, as was my 2nd T2 (current_employer) in 2014-2016. My current/latest CoS (2016-19, salary: £31k) uses PhD level SOC code 2119 (changed job in same company). Do I still get salary exemption as last 2.5 years of my 5 years have been on a PhD level SOC code, or did I need all 5 years on PhD SOC code?
  2. Job title and Salary changed (promotion): In Oct. 2018, I got a promotion at work that saw the job title change from Senior Bioinformatics Scientist and annual salary rise from £33k in 2018 (was £31k in 2016 CoS) to around £38k now.
I spoke to my current_company HR today and they will add a sponsor note to the CoS today via the online SMS system ASAP to notify UKBA that it is a promotion to a senior position (within the same job type/description) and core duties remain the same. Hope this is sufficient?
  3. Salary differs in Payslips: Similar to above, my last 3 payslips have different salaries. 2 have old salary (based on £33k p.a.) while 2016 CoS showed £31k p.a., while Dec. payslip is over £38k p.a. (as promotion was backdated to Oct.). So, no payslip shows actual, current salary (£38 p.a.) until I get my Jan. payslip. Should I apply already (and submit only Dec. 2018 payslip showing new salary + backdated hike) or wait until April, I have 3 payslips with new salary? please help.
  4. For letter of absence from old_employer, I worked there on T1 PSW from 2012-late 2013 and then on my 1st T2 BRP (2013-14). Should their letter include all absences in my time there (2012-14) or only the 1 year T2 BRP period for ILR? Any thoughts?

Note: that old_employer is no longer a T2 sponsor (as they no longer have overseas employees), is that okay for me?

Also, Is this template ok to use for the letter: indefinite-leave-to-remain/employer-let ... 52143.html

    Other doubts:
  5. In the online SET(O) form, it only asks for current address, where do I provide details of older addresses? as I moved to my current house in Sept. 2018 only. Should I attach a letter stating my older addresses while under T2 Gen. visas and also provide old rental agreements) or is it not needed?
  6. Have read a few posts here talking about current and old P60 forms? Do we need any of those?
Thanks a lot for the help so far, looking forward to responses from you soon. Thank you. :)

Re: applying for ILR? eligibility, documents questions and new VCAS system

Hi everyone, does anyone please have any advice/feedback or thoughts regarding this? I asked on indefinite-leave-to-remain/set-o-paysli ... 71870.html but that was locked (as was a re-post).

Still awaiting a reply for:
1) I am on a PhD SOC (2119) since 2016 but was on a different SOC (2136) in 2013-16, do I still get salary exemption for ILR?

2) finance docs: only last month's bank statements (1) and last (1) payslip (so Dec. 2018 for me) needed? no 3 months bank statements/payslips or P60's?

3) Salary query: Salary on my current CoS (2016-19) was £31k, slowly rose to £33k by 2018; in Dec. 2018, it rose to £38k after a promotion. Employer has added a sponsor note to the CoS explaining the promotion. In the online SET(O) form, I have stated my current salary (£38k) and working hours (37). But my last payslip (Dec. 2018) has backdated promotion pay (for Oct/Nov) so the amount paid is higher than £38k equivalent. Will this difference cause any major issues?

Don't know how to proceed... :(

Hi, any advice please? :
can a typo/error in a sponsor note on CoS be edited/amended after adding it, or do we have to add a 2nd sponsor note to revise the error in the 1st note?

urgent Advice needed, thanks.

Also, a recent post: indefinite-leave-to-remain/successful-a ... 71120.html says only 30 days bank statements are needed for T2 to ILR and not 3 months ?

Is this correct??

Hi, would be very grateful for some advice soon; haven't had a response in over a week, hence the re-post...
1) I am currently on a T2 CoS (issued: April 2016, SOC: 2119/ phd level). My salary increased in Dec. 2018 after a promotion from £33k to £38k. My employer has added a sponsor note to the CoS explaining the promotion. Also, as I am on 2119 SOC code, I believe I'm currently exempt from min. salary requirements, so the salary change (close to ILR application) should hopefully not cause undue suspicion, isn't it? :? :(

2) My Dec. 2018 payslip shows a higher amount than my new salary as well, as it includes some backdated promotion pay as well. As the promotion was granted in end of Nov., to be paid in Dec. payroll but backdated to mid-Oct. by the company. Is this okay or will it raise red-flags for UKBA?? :(

3) I am including last 1 payslip (Dec. 2018) and 30 days bank statement? Do I need more payslips or more bank statements??

4) Note: while adding a sponsor note, my employer made a typo in spelling. Can they edit the note now or will they have to add a 2nd note to revise the error?? :!:

Thanks.

Re: applying for ILR? eligibility, documents questions and new VCAS system

Post by AjPS » Mon Jan 14, 2019 9:45 am

Having completed the online SET(O) form for ILR based on 5 years on Tier 2 General BRP, the form only asked me to fill in: 1) current address, 2) passport details, 3) date 1st entered the UK, 4) travel history, 5) English language, 6) National Insurance number, 7) end date of current visa, 8) BRP number, issue/expiry date, 9) passed Life in the UK test, 10) current SOC code and salary.

It does not ask for employer name, job title, CoS id, etc. ???

The document checklist in the end lists:
1) Passport (mandatory)
other docs:
2) Life in the UK test pass notification
3) Letter(s) from employer(s) details reasons for work-related absences including periods of paid annual leave
4) English proof: degree
5) Evidence of immigration status: guess it's BRP?
6) Declaration signed to confirm consent for Home Office to request verification checks; guess I'll come across this after completing this form.
7) Most recent payslip and most recent bank statement (dated no earlier than 1 calendar month)
8) A document from sponsor confirming: still required for the forseeable future, nearest applicable SOC code, current pay, confirmation that pay is at/above appropriate rate of pay; can this be combined in the employee absence letter at (3)?
9) For the period before you were granted leave as a Tier 2 migrant, documents showing that you
met the relevant requirements of the immigration rules; not sure what this is?
10) current BRP

is this correct?

What document do I need for this?? I was on a T1 PSW before switching to T2

Hi everyone, I have all the required docs now, and am trying to find an early appointment via ukvcas.

I am submitting latest payslip with latest bank statement (30 days). Just curious:
My CoS states salary as £38k but Dec. payslip shows 2 payments: salary (as BASIC), 1.5 months backdated promotion pay (£600 extra, as ARR BAS), due to my work promotion being granted in Dec. payroll but backdated (to Oct.) and £ difference paid in Dec. payroll. Will this cause issues? Or am I better off waiting until I get Jan. payslip that will match salary on CoS...

any thoughts?

FYI, I'm applying next week at London Premium Lounge using the 1 payslip (Jan) and Jan. bank statement (generated at the bank for Jan 10 - Feb 5, stamped by the bank as well), as the form asked for latest payslip and bank statement only. Have paid £3020~ online and booked appointment (£200).

Also have uploaded online: passport .pdf, BRP .jpg, Masters degree .jpg, Life in the UK test .jpg, current employer letter .pdf, old employer letter .jpg , bank statement .jpg, payslip .pdf, filled consent form .jpg and my travel history .pdf

Just wondering:
  • Do I need to upload scans of old T2 BRP's I had??
  • Do I need a cover letter summarising my case, mentioning all 3 BRP's, CoS, etc. ??
Awaiting feedback from Sopra Steria regarding upload quality and if I need anything else. Planning to take all originals with me to the appointment. Hope that's all ok. :)

Thanks @CR001 .

I applied yesterday at London Premium Lounge (super priority):
  • Type: Set(O) Tier 2 General (5 years) to ILR
  • Online application submission: 05 February 2019
  • Documents uploaded online: 06 February 2019
  • <paid for Document Checking; got positive e-mail from UK VCAS on 11 February 2019>
  • Biometrics appointment: 13 February 2019, 10.30 am
  • Decision/approval e-mail: waiting...
  • Decision letter (post): waiting
  • BRP (post): waiting
<Feb 14, 12:30:
I just got an email from Tier 2&5 Temporary Migration Consideration saying that
"Thank you for your application for permission to stay in the UK. Although we would normally decide within 24 hours, unfortunately this is not going to be possible in your case, because you did not provide all the relevant evidence. Please provide a letter from your employer clarifying the reason your pay on the bank statement which you have provided, appears as <another_name>. We can accept this is a written statement provided by your employer by email in the interest of a prompt consideration
".>

I spoke to my company HR and they sent me a letter PDF stating we outsource our payroll management to an external provider. Have replied to above e-mail with letter PDF attached. Now, waiting for some response... So:
  • Did I do the right thing?
  • Just to confirm, this e-mail source (Tier 2&5 Temporary Migration Consideration) is for the Set(O) ILR route, right??

Update: Just received an e-mail saying: "...your application for leave have now been granted. You will receive your decision letter and biometric residence permit (BRP) in due course and these will confirm your immigration status. Thank you for using our super priority service."

Does that mean it's all done? :)

No mention of any refund though but I guess that's because they needed 1 more doc (payroll clarification) from me.

Re: applying for ILR? eligibility, documents questions and new VCAS system

Post by AjPS » Tue Feb 19, 2019 7:10 pm

couple of questions:
1) What do I do now with the old T2 brp? Do I need to re-send them to avoid any penalty? or just archive it in my personal records.
Note: The prove right-to-work website shows me the same new status with both BRP id's, only using the new BRP ID shows my new photo as well.
2) if I move house, do I still need to inform UKVI, or was that just for T2 BRP's??

Thanks.
