Applying for ILR

Post by Kakaman » Mon Jul 18, 2022 10:38 pm

Hi guys,

I came to the UK on the 15th of August 2017 and my five years will complete on 15th of August 2022 under spouse visa, just a few questions
1) when can I apply for ilr
2) I am travelling abroad for 3 weeks in August can I apply straight after coming back or is there a rule that's says don't do it
3) is the process of applying online?

Thanks in advance

Thanks Amazonix

A few follow up questions please.
1) in the finance section do we have to provide the optional documents like work contract or p60. Is it considered good? I don't have a P60 so worried

2) can I use the bank statement by post as evidence without getting them signed from the bank?

3)in the home section they ask for housing costs, do I need to provide the mortgage statement or council tax in that?

Thanks in advance,

Kaka

P60 is an optional documents so need to include.

You can do that or download it from online. Caseworker now accept downloaded statements as many members from this forum have used successfully.

3)in the home section they ask for housing costs, do I need to provide the mortgage statement or council tax in that?

Council tax and mortgage statements should suffice.

Thanks in advance,

Kaka

P60 is an optional documents so need to include.

So I must include it even though it's optional?

Another question I found confusing was
Other reasons to stay in the UK
During my flr I replied no as I didn't have any kids at that time.

This time I replied yes, and mentioned my daughter would suffer if I don't stay in the UK.

Now they are asking for document supporting my other reason to stay in the UK?

What documents are these can anyone help please?

No need for P60, no need to provide any other reasons to stay here.

Hi zimba,

Thanks for your prompt response.

They specifically asked me to submit and check the box that says I'll provide evidence for other reasons to stay in the UK.

If I don't provide anything won't it go against me?

Nope it wouldn't as you been advised already by Zimba. Your reason for staying here now is because you live, work here and love being here. You can't really evidence that.
That clause is there for those that have specific reasons, probably loss of spouse, domestic violence, been to jail or something very specific.
No sin in failing, you just have to try and try again!

Thanks both,

Just to be clear I need to answer yes in other reasons for staying in the UK because it mentioned having a child etc
But not need to provide anything as evidence

Another question here is for housing cost evidence

I'll be providing land registry and mortgage agreement
What should be the duration for council tax evidence 2.5 years or 5 years?

If you do not answer to that question on the form, then the checklist will not ask for that evidence. :!:
The answers you enter on the form affect the final document list.

But not answering to that question won't be correct as I do have other reasons to stay in the UK. My daughter, house job etc.

I repeat again, you do NOT need to provide any other reason when you are eligible for ILR as per rules. The reason why you are asked to provide extra evidence (if you answer that question) is that the online system thinks you are NOT normally eligible for ILR and you require UKVI to consider other evidence to grant ILR if they see fit. The answer to that question is therefore irrelevant. You do NOT need to answer that question as you are eligible anyway. The form is not asking for a 'full disclosure'.

Thanks zimba.

That makes sense. Regarding my question of housing costs

What duration should I cover as it's not specified? 2.5 years or 5 years or council tax and mortgage statements.

Housing costs

Under paragraph 12(f) of Appendix FM-SE, the applicant must provide evidence of
the monthly (or weekly) housing and Council Tax costs for the accommodation in the
UK in which the applicant (and any other family members who are or will be part of
the same household) lives or will live if the application is granted.
As the calculations at Section 3 above refer to a weekly housing cost, any costs
evidenced which are not weekly should be converted to a weekly figure, rounding
down when this leads to a part of a penny.

Example:
If a calendar monthly Council Tax figure is evidenced, then multiply it by 12 and divide by 52 to arrive at the weekly equivalent.
Monthly Council Tax = £100 x12 divided by 52 = £23.07 weekly equivalent cost of Council Tax.

Applicants should supply documentary evidence of rent or mortgage payments and Council Tax, along the lines of:

• a letter from the landlord or mortgage provider detailing the weekly or monthly rental or mortgage cost of the property
• at least one personal bank statement to show the rent/mortgage payment leaving the account of the sponsor, their partner or the couple jointly
• rent book (if available)
• letter from the local authority detailing whether and how much Council Tax is payable

Hi guys, one more question.

I have got all document except one and I'm waiting for it.

Can I pay for the application now and book an appointment later when I get that document?

How long after payment do you have to book and appointment?

Any suggestions would be welcomed please

Hi guys another question please,

So I have already applied for the visa on 1st sep and for my housing cost I am giving mortgage statements

Mortgage statements come every year on the 1st of July and cover till that period. So that means I won't have housing cost for August and September is that alright or do I need the go to the bank and ask something.

Thanks,

Kaka
