Applying ILR. Help Needed

Hi,

I am planning to apply for ILR. I have few doubts. Please can any one clarify?

I came to uk as WP in 2006. My wife and Kid also accompanied me.
In 2008 I changed my Visa status along with my dependents into HSMP.
In 2010 I extended my visa to tier1 at that time my wife and kid were in india and they applied their dependent visas from india and joined me back around 11 months back.

As my wife and kid stayed with me from 2006 as my dependents and just 1year back they applied their tier1 dependent form india I am in confusion.

Can I apply ILR for my dependents along with me.

Your child may be included in your ILR application.
If your wife has spent at least two years living with you in the UK, then she may also be included in your ILR application.

Thank you for the reply , but i have one doubt. before tier1 she stayed in uk for 3 years . but after tier1 extension she is here only for 11months. is this ok for aplying ilr.

You can get lucky. I suggest you apply for them as your dependents as per HSMP policy document, assuming that that you had HSMP before Nov 2006. Also if your dependents obtained tier 1 extension from India near about the same time as you did, it may work in your favour.

After Nov 2006, HSMP policy document doesnt apply, so 2 yr stay will be mandatory for your spouse.
