Set (O)_Financial support question

Post by anavuhb » Mon Jun 15, 2020 6:35 am

Dear team

I am filling my ILR application under Tier 2(General) category. I.am applying for only myself and not my dependants at this point.

I came across question below:

Does the account with the bank or utility company
for which you have supplied information and
supporting documentation relate to another person
who is to provide you financial support?

I am providing evidence of Tenancy agreement which has both my husband (dependant but working) and my name.

My husband pays rent out of his bank account.
Apart from this every month he sends me 1000£ to save some money to buy a house in future,

Question:
1) Is this (paying rent and £1000 every month) treated as a financial support?
2) Should we provide the part 3 of the consent form? If so, who should sign this?
3) We are living in this house for nearly 4 years, should we provide all 5 years of our Tenancy details and proofs of only the current Tenancy is sufficient?
4) Providing Council tax as address proof. I only have council tax for the current house for 4 years, is this sufficient? Or should I give the previous house council tax as well which I do not have currently!!

Kindly advise
Regards

Hi,

Since you are the main application then you only need:
  • The passport
  • The UK degree certificate OR English Test evidence
  • Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies
  • Signed declaration to confirm consent for the Home Office to request verification checks
  • All previous passports, travel documents or national identity cards that you have used to travel to or remain in the UK(If there are any)
  • Current Biometric Residence Permit
  • Your most recent payslip and bank statement
(The last payslip and statement must be dated no earlier than one calendar month before the date of the application)

  • A document from the sponsor confirming that you are:
still required for the employment in question for the foreseeable future, and
the nearest applicable SOC code which best describes your employment
your current rate of pay, and
confirmation that this is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors

*The Bank statement you are providing where your salary gets credited if it is held under joint name then both account holders will have to sign the consent form, otherwise you will select "No" for the question you have asked, you will only need to give your consent to HO to do the verification checks.

The only documents required are mentioned above, the p60s, council tax letters and tenancy agreements are not required for you to apply for ILR if you are main tier 2 holder and applying on 5 years basis. You will need them as evidence of cohabitation when your husband applies for ILR as your partner once you have ILR.

Thank you so much for the clarification. Much appreciated.

A) One more question:

In July 2018 I got my BRP extension. That time I checked my name it seemed ok to me. Lately, in March 2020, just before lock down, I noticed my surname and first name were swapped. Hence, I immediately notified BRP office about this error. They sent me a new one with the correct name.

Now question is:
Should I also submit the copy of my previous BRP that had an error? Perhaps, I have a copy of this.
Should I mention this in a cover letter?

B) Due to Covid 19, my salary was reduced along with working hours by both 70% for last 2 months.
My salary was around 31k due to this. Now it is back to what it was (around 40k). This reduced salary is reflected in my current pay slip. However, I was recruited on Shortage of occupation.
Will this be a problem?
Should I write this in a cover letter?

Please advise.

Hi there,

Let's wait for any senior member to respond to this.

I'd personally provide the latest BRP only and wait for the latest payslip if my visa is not running out you are exempted from the threshold anyway as you said your job is in SOL.

KR,

S

BRP issue is not relevant. Your reduction in salary due to COVID is fine as your salary is back where it was

Change of priority from standard to Super priority

Post by anavuhb » Sun Jun 21, 2020 9:59 pm

Hello Team,

Hope you are all doing good and safe.

Could you please advise me if I can change my application from “standard service” to “super priority” service.
I have not submitted my application yet but completed filling it.

The amount showing on my application is not of super priority, but standard. I am unable to find an option to change the priority.

If I cannot change it, can I create a new application with the same email id and contact details or different?

Kindly advise.

Regards

Thanks for this link.
Does the priority option appear in the beginning of the application or at the end before submitting. Please advise.

If it is too late for changing the option, can I create another application, as I haven’t submitted the one I started?

I only completed the filling of application to check what documents should I keep ready.

Please advise.

Thanks for this. My question is at what stage of the application, do we select the priority? Is it is the beginning or at the end of the application after Declaration?

It is at the end, before payment.

Thanks for the prompt response.

So I should be good with the current application itself as I haven’t reached to the payment stage yet. And have to wait until the super priority option is allowed by the gov.uk to avail this option. Currently my completed application is showing standard service amount of £2408.20, don’t know how!!!

Thanks once again

There is no indication when the super priority service will be available. You might be in for a long wait.

Not sure what you mean by 'don't know how'? This is the normal ILR fee plus £19.20 for biometrics.

Priority service is not available as pointed out to you. The service very likely may not return for months (possibly until the end of the year). You must not wait to apply if your visa is expiring. Proceed with standard option. That is THE ONLY option available now

Thanks once again for your reply. The reason I wrote “don’t know” is I have not gone to as far to the payment stage to chose for an option. Maybe it is a default, set to standard service.

Hi

Below is an extract from the guidance from gov.uk website for calculating absences.

Could you please clarify in the statement below, the meaning of ‘specified period’? Is it 5 year anniversary?

“ Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.”

Thanks in advance

One more question, please help

My salary got credited on 20th of June and bank statement will be generated only on 14th July which reflects this June salary.
Hence, I requested the bank, for bank statement on 3rd July which shows my June salary. But the bank statement is generated between 14th June to 3rd July (Not whole month).
Is this statement ok or should it be for a complete one calendar month ( 3rd June to 3rd July ) ?
I was planning to submit this application today, but because of this question I am stuck now.
