Days absent from the UK confirmation

Post by amricu » Thu Jul 11, 2013 9:53 am

Hi Experts ,

arrived to UK on Jul 2008 and applying this month for ILR . the following is the calculated absent days backword

Jul 2009 to Jul 2008 (36 Days)
Jul 2010 to Jul 2009 (36 Days)
Jul 2011 to Jul 2010 (50 Days)
Jul 2012 to Jul 2011 (55 Days)
Jul 2013 to Jul 2012 (10 Days)
Total 187

can you confirm if this is okay as im im confused with the info on that "During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months"

i guess it should be okay if i do not exceed 180 days during a year. however , some posts here reference the residence period as the whole 5 years

Thanks in advance
Amricu

No more than 180 whole days absence are allowed in any of the five, two, three or four consecutive 12 month periods, preceding the date of the application for indefinite leave to remain (ILR).

You are absolutely fine. I'm not expert though.

In my opinion it is suffice .
Keep bank statement and pay slips for the period you were on leave and you can produce if it is required.

One quick question . SET(O) guidance says that everything should be filled in black and capital . Reason for abscence also i'm filling in capital like 'PAID ANNUAL LEAVE/FAMILY VISIT' . Is that OK ?

Tier 1 absence query

Post by Soul&Karma » Fri Jul 12, 2013 1:20 pm

Hi All,

This is for my wife. She is in Tier 1 General visa.

My query:

Is the delayed entry ( visa issued to the date of Entry to Uk in my wife's case it is 75 days) classed as absence for that year or the absence starts after arriving to UK?

visa issued - 21-Jul-2008 Initial entry - 05-Oct-2008 ( Gap 75 Days from visa issual date )

The following is the list of absences for the past years.

Year 5- 21-Jul-08 to 20-Jul-09 - 71 (Days outside UK)

Year 4- 21-Jul-09 to 20-Jul-10 - 61 (Days outside UK)

Year 3- 21-Jul-10 to 20-Jul-11 - 83 (Days outside UK)

Year 2- 21-Jul-11 to 20-Jul-12 - 20 (Days outside UK)

Year 1- 21-Jul-12 to 20-Jul-13 - 18 (Days outside UK)

Total 253 Days

Can someone please if she is qualified for ILR. Planning to apply around 31/07/2013.

Thanks for all your help.
