Absence from UK

Post by fatimahanif » Tue Aug 07, 2012 9:02 pm

Hi All,

I have an appointment for Croydon PEO on 16th Aug for ILR after 5 years of HSMP under judicial review (not for ILR). I am getting confused and worried about the number of days out of UK. Could anyone please guide me how many days are we allowed to be outside UK. I thought it was not more than 90 days in one year. But reading some of the other posts it seems its different. Also where I can find this information on UKBA website. What about annual leave allowance with other members are talking. My total number outside UK in 5 years are 211 but maximum in one year is 58 and all other average around 40. Please help me. I am really confused and to be honest a bit scared that this will become an objection.

thanks in advance.

Hi

Just now i received a reply from MP that they have received response from UK BA . Our MP enclosed UK BA Response along with her letter.

In UK BA Response , they stated that my application is in active consideration.

Does any body knows what is that meaning ?

are they processing the application now ?

Regards
Krishna

no idea.. i was reading other thread . one guy is still waiting from last 2 1/2 months of getting this 'in active consideration'

we can't push UKBA to make decision quickly . they will take their time. i wonder how come some people complain to MP and they got in 2-3 days.

Hi,

I received MP letter along with UKBA reply. in my one UKBA letter saying ' my case is awaiting consideration' ? what it mean ??
i think it means no CW is looking into that case etc.
it also states that according to records in our data base here is the info.. date i applied, type of application.

It look like they check from data base and give reply to MP. they didn't ask Liverpool PEO to check status ?

what you guys think ???

and my MP say contact her if i want to take this matter further - means she will not be chasing UKBA ? am i correct ?

It was mine misunderstanding, she complained to HO not american express!!!!..

She wrote a very good letter that her case was a straightforward, she had a travel plans, not been treated fairly and in line with the standards etc.
She posted it to
1. UK Border Agency, Lunar House, 40 Wellesley Road, Croydon,
Surrey CR9 2BY

2.ukbacustomercomplaints@homeoffice.gsi.gov.uk
3. local MP
in 3 days acknowledge letter

Alternatively, you may write to us at.
UKBA Complaints Team,

in 20 days the answer was from HO that they are unable to give refund because officers do not control IT issue and offered to complain further
to
David Fyfe, London and South East Region, Customer Service Unit, 17th floor, Lunar House, Croydon, CR9 2BN
she wrote and got the refund..
they offered to complain ombudsman or MP if she still is not satisfied.

there is no address for Liverpool
http://www.ukba.homeoffice.gov.uk/about ... o-complain

just explain your case to them in good language
maybe she got the refund because CW said that her case a very straightforward and arranged another appointment in 3 days.
So she wasted another day at PEO.Finally she got BRP in 3 weeks..
your case are not straightforward, absence>90

She said on the phone that because I left the country for 90 days after being in the UK for 10 days, that "didn't look good". I guess it doesn't look good (I decided to get some travelling and family visiting out of the way before getting a job) however that statement isn't part of any legal
Hi Missgolightly!
After tier1 extension you can try Judical review. There is a chance to win..HO decision is very unfair to you. They do whatever they like,
They have to be stopped and prosecuted for taking decision whimsically.
They don't even follow own guidance which states that absence more than 3 months breaks the continuity.Nowhere is written 90 days..
3 months even sometimes =92 31+31+30=92 [/quote]

PEO Premium service available for 10 years ILR?

Post by Renni_Aman » Sat Jun 29, 2013 4:11 pm

hello all, I am hoping that someone out there might have a reasonable answer for my long researched question (which I am still NOT yet cleared on).

Is there a PEO premium service available for 10 years ILR applicants? Apparently, the UKBA website is saying that this service is not available for long resident visa because of complex cases. However, some solicitors and visa experts websites are saying that applicants have both postal and PEO choices for their visa.

IM CONFUSED!!! And hope that someone can shed a bit more light here with experience!!!

Thank you :)
