Great News: 60 days unemployed period (245AAA(b)) removed from new rules

Hi twcbbr,

As it is mentioned in the first post, the rule is removed all together. So, it doesn't matter when you got COS. You won't be refused ILR due to employment gap. Hope it helps.

Dear Mengo, thank you for sharing this revolutionary news! I just want to clarify your interpretation. Is my understanding correct that new rule will apply regardless of the date of issuance of the CoS and Tier 2 Visa.

My latest and current visa was issued in 2015 and expires in Sep 2018, so I would like to confirm if I need to extend it again to be eligible for ILR (under new rules with 60+days gap).

Your advice will be much appreciated. Thank you.

Hi Sergino,

As I mentioned above, the rule is removed all together - doesn't matter when you got your Tier 2 visa. Your ILR application won't be refused due to 60 days gap. Thanks
