Help for ILR

Hi Marcnath/ Zimba and all

Thanks for your ongoing help and support , much appreciated.

I have got one employee through out my extension application, but another full time left but I do have one part time still , so one full time employee and one part time employee, now my five years will be finish in next year May so I believe I can apply for ilr after having two full time for one year or just add one part timer so I will have one full timer and two part timer to make upto , is this ok ?

My daughter has not been in to tier 1 five years , what application I need to do for her ?

And last is there any income requirements for me or wife in tier 1 for ILR application or nothing ?

That depends on whether you can send in your application before 6th April 2019, which is when the transitional arrangements end.
After 6th April 2019, you can still have full time and part time jobs (note it is jobs, not employees) but there is a condition that all jobs you are using for job creation should have lasted for 12 months each, at the minimum.

Don't understand the question. What visa has she been on ? Is she born in UK ?

There are no income requirements. There is a general requirement to show that you will not depend on benefits but it is not specified what form that should take. Any income, bank balances, etc. should help with that. So far, haven't come across any rejection on that basis, so I think it is just a generic requirement.

For employee, so that means I should have two full times for claim point rather than two part timers and one full time to avoid problem, and I won’t be able to apply on 6 of April 2019 as it will be too eat early as 5 years finish on 17th of May 2019.

She will apply extension for PBS dependant.

Again, you can have part time jobs - no issues.
The change is that every job should be minimum 12 months.
So 1 FT and 2 PT will work as long as all of them have lasted for 12 months each.

Up to you.

As you have one FT employee - that will satisfy 1 job.
You have more than 12 months to your extension, so you have many options.
- Make your part timer full time
- Hire another FT
- Hire another part time for 12 months, who can be combined with the existing PT

You only need to send them the FPS reports for the period of employment you're using to claim job creation points. The requirement to send them the old FPS report showing start date is NOT there anymore. You can just confirm the start date in the application form.

Hi ,

My wife , she has not done any courses or IELTS , will she need to give B1 test and life in uk test and for me I have done my masters , so I only need life in uk test ?

Is this correct ?

For you, you only need the Life in the UK test certificate. For your wife, I am not sure what the requirements are.

I am a dependent. I have just passed LIUK test, now I need to go for B1 Test .. main applicant my partner needs only LIUK test , because for English
Language purpose he already has degree taught from UK university. All the best to you and your wife..!

Hey sunny,
Just today I found that I (dependent )
Need to give B1 test on some specific level as follow:
IELTS Life Skills B1.

My route is 5 Year from entrepreneur to ILR.
First I was going to do it from Trinity GESE level but today our solicitor told to use the IELTS life skills B1 which I have found on British council link (also on gov link ,pasted -nice)
Please be sure which one your wife needs... !

What did she use for the initial application/extension? In most cases, she would not need a test unless the earlier one is no longer an acceptable qualification

Hi marcnath ,

She never gave language test and she always been to my dependent on my tier 4 from tier 1 entrepreneur, and doesn’t have IELTS or anything else as Indian degree only . But she is only apply my dependent on my ilr application.


Also I have got one question, when I was on my PSW visa , while I was working , my manager and other staff members advised me to claim working tax credit which I did and got some working tax credit ,do you think this will be any problem, I never claimed anything else , just this !

In regards to English test B1
Dependent can choose between GESE grade 5 (trinity college) OR
ILETS life skills B1 (British council’s)
got confirmed from the solicitor.
About claiming tax.. my thoughts :
Just think your route to ILR is enterpreneur’s 5 years (with providing all rule conditions) so how
Something on PSW thing could matter that what something legal or rightful. I think you should not worry.. good luck.

Did you pay the working tax credit back to HMRC??

If you had 'no recourse to public funds' on your PSW visa, then you were not permitted to claim and were in breach of your visa.
