ILR - Accomodation/overcrowding

Hello,

Can someone please provide me some guidance on the accomodation issue.

Basically, I am submitting an application for ILR (Set M) after completing 5 years in the UK. For the accomodtaion I am living with family and not really sure if my situation falls under overcrowding.

The property has 3 bedrooms and a living room (not connected to Spam etc). Currently there is a married couple living in one bedroom room. Me and my husband share 1 bedroom with our new born child who is 7 months old. The other bedroom is used by 2 children both aged under 8 who are both of same gender. In the living room is one child under 8. Is this overcrowded?

Based on the guidance I have read, part x of the housing act it says the living room can be considered as adequate sleeping accomodation.

I have checked guidance under appendix FM and my understanding is that based on the room standard and the space standard currently there is 5.5 occupying the property. ( 2 married adults in one room, 2 married adults in another bedroom, 2 children of same gender both under 8 in one room, and another child under 8 in living room) children 10 counted as 0.5 people and under 1 ignored. So total occupants = 5.5 people.

Based on the room standard or space standard (as the rooms are all greater than 113 sqft) maximum allowed persons for this property is 8 people for the given scenario of people, age and gender etc.

Please can someone shed some light if this is correct or is the property overcrowded maybe?
