Sorry to hear about your friend its unfair
As per their guidline they must not reject nor invaludate

They must give applicant 10 days to complete right form and post it

Hi Mkhari
You have similar case as you told home office accept your application as valid.
They did not reject your application but passed to the revalrnt department to make further checks is it right.
Where we can find that guideline they must not reject nor invalidate

Can you highlight please any link ?

Bro luqi
You r right they accept my application as valid but keep it for further check and its more stress
They can accept it
Reject it again n ask for send it again on right form
Or can give me 10 days to send at right form
I m not sure what to do

Below is link if someone applied on wrong form
Home office obliged to send letter n ask for fill right form in 10 day

I have feeling that you will get ilr on PEO

Just write simple covering letter that you are applying ilr after completing 6 years
According to home office publish policy on dlr
Section 10 transitional arrangment

hi mkhari
did home office ask you to send it again correct form is it correct or you was just assuming above. clarify please?
did you attach transitional arrangement section 10 with your application??
thank you bro.

if you nothing heard from home office after your PEO appointment so its mean you have to wait for your turn to be come.
hope for the best bro,

My understanding is, after you attain ILR, if married to a British spouse, you can apply straight away if not you need to wait 12 months plus any other requirements, if this could be confirmed pleaae

My point is due to good character
Every failed asylum have to complete 10 years on leave

Because b4 6 years we were not on leave
So it might b breach

Senior can shed some light

Yes, you are right, if there has been a period of overstaying of more than 28 days (im assuming after your valid leave) then the application for naturalisation may be refused.

So, yes, it may apply to most cases of applicants that apply before 10 years that had DL granted from a failed asylum application before attaining ILR.

Sorry didn't realise this until i further researched into it, as i was going by my wife example as was granted DL but hers was non asylum and my understanding is, all applications were made intime even the one that was refused that resulted in her being granted DL. will need to further clarification on this, its getting a bit confusing

If you where to start your own thread and post your full immigration history you will probably get help, with that Information provided, I don't think anyone can help like that.
