ILR Application from Tier 1 Ent

Dear Team,

I have my ILR application from Tier 1 Entrepreneur route in 1 week time and I would appreciate if someone can help me with the following:

1. I am director of 2 businesses. In business 1 I had 2 post. 1 post lasted since 2014 till date, so I am claiming job creation for Pre-transition period for 24 months with 1 employee.

a) My question: Do my accountant or I have to mention the other 3 employees (from my business 1) I had for which I am not claiming points? (in accountant letter and in form)

b) My second business had 6 months of worth job created. However, I am not claiming points from this business at all do I have to mention about my second business in cover letter or accountant letter or in form?

2. Do I mention about the second business at all in my application?

3. Do I require to send any documents to prove genuiness of business such as business activities, customer receipts and contracts?

thanks for your response. I joined existing business intially when I entered the route. So do I need accountant letter now? (i did provide accountant letter during extension)

Do I mentio about employees I am no planning to claim points?

yes you will need an accountant letter in this case. Read the accountant letter requirements in Tier 1 guidance what it needs to confirm. It only needs to confirm the employment you are claiming points for though. Page 32

You need a lot more documents than just the three mentioned. You have to apply online and then the system will divert you to the third party website sopra where you have to create an account and upload all your douments and book an appointment for biometrics.

Thanks for your help. Yes I do know that I have to apply with lot more documents. But I was not sure which section I should attach my cover letter?

However, I am planning to apply with following documents. Please can you confirm the same

1. Passport of myself and my depandent
2. LIUK test certificate
3. My degree and my partnes english certificate
4. Bank statement 3 months for myself and my partner
5. Cover letter

Cohabitation documents
1. Water bill
2. Visa letter
3. Council tax bill

Business documents
1. CT41G
2. CT600
3. CT603
4. Business bank statement
5. certificate of incorporation
5. directors appointment certificate

Employee documents
1. copy of passport and biometric
2. 24 months fps and payslip, p32, p60
3. Accountant letter

Genuiness of business (don't know which section should I attach them?)
1. business bank statement

Please advise if I am leaving out any documents?

You need Current Appointment Report (CAR) with recent filling history page VERY important

Employee documents
1. copy of passport and biometric
2. 24 months fps and payslip, p32, p60 check the guidance if you need p32 and p60 since you took ovef a business otherwise its not required
3. Accountant letter

Genuiness of business (don't know which section should I attach them?) optional not required but anything related to business will may go in the “business” category
1. business bank statement
2. business activities

Please advise if I am leaving out any documents?

Just to be sure. I do not require to print fps and payslip and then scan them to ukba system? I can download softcopy which my accountant has provided and load it to their system?

Its advisable to take all hard copies with you. They dont check though. But incase there is any issue in the scanned copy and they need to scan again.

I have ct603 of previous year. I still did not receive current accounting period ct603 even though we have closed our books. Do I need to send current year or 1 year is enough that I have of 2016-17 period?

CT600 or CT603 or CT41G any one of them should be okay. New or old the guidance does not specify. You should be okay.

Ignore my message. I read your post wrong.
When you say 24 months. Is that period since your initial 3 years or extension 2 years?

Because as I understood if you are counting extension period from 2014 your 2 yr extension should have completed in 2016 or 2017 max?

I am not 100% sure but P11 & P60 should cover employee payment records.
Zimba said same thing in this post

I am in same situation as you are.
With regards to documents I am also confused if we are supposed to submit job creation details for extension period or all 5 years.

I think since extension was granted on basis that job creation for initial period was satisfied so I would think we just need to supply documents for extension period.

Please wait for someone else to confirm this.

You can only claim job creation AFTER extension for ILR. The evidence needed will only be after extension to cover the whole period of CLAIM NOT the whole period since employee start date.

What if the extension visa starts 6 months after initial visa expiry?
For example: My initial visa expired on 12/09/2016 but my extension visa granted on 20/03/2017
So should we supply documents from 12/09/2016 or 20/03/2017?

The waiting period has no relevance to the case. You can only claim employment AFTER extension. Evidence will be after 20/3/2017 in above case and needs 104 weeks or 24 months of employment after 20/3/2017.

The waiting period will only come to benefit if your ILR date is within 12 months of extension date. In that case you can claim for employment immediately 12 months before the date of ILR.
