ILR Application - salary slips

Hello Imb's,
I need to apply for my wife ILR expiring in Feb 2018, please can you help me with below questions:

I little bit of our background, I am a British citizen now ( granted in yr 2015), ILR granted Jan 2012.
Wife came into UK in Dec 2012.
Type of visa : Spouse/Partner. (which was extended in 2015 to last Feb 2018)

1) What form should I use for ILR, after reading all documentation it looks to be SET(M), but would be good if someone can confirm.
2) How many months cohabitation documents we need to show, whole five years or last 3 years since the last visa extension?
3) We are thinking of going premium day service, should I fill payment section still?
4) We have a baby born in 2017, should we provide any of his documents?.
5) Accommodation: I am thinking of show mortgage lender letter addressed to both of us, property deed copy, house floor plan, should this be enough?
6) My spouse gave IELTS in 2012, should this be still valid for ILR English requirement?

SET(M) is correct form someone settling from FLR.

Last 2 years.

NO. You'll pay online. You'd leave payment section blank.

Provide birth certificate as proof for cohabitation

5) Accommodation: I am thinking of show mortgage lender letter addressed to both of us, property deed copy, house floor plan, should this be enough?

6) My spouse gave IELTS in 2012, should this be still valid for ILR English requirement?

Where did she take the IELTS? Was it IELTS General?

She needs English B1 for ILR and it must be from a test provider on the HO approved list.

She also needs LIUK.

The IELTS was general category
(Gave it for entry visa) and was given from an approved provider at that time. I am not sure if it's is still an approved center. It's been used to get visa first time and for an extension.
This should be still valid, to pass english eligibility criteria right ?

Life in uk test passed last year.

Also i am thinking of going for premium same day service and settlement checking service. Do these need to happen on same day? Or i can get settlement checking service done few days before by appointment for premium same day service. I know for postal service, documents after verification are posted straight to home office.

What level CEFR is her old test? A1...? Likely the test has already expired too. She needs B1 for ILR.

Settlement checking service is for POSTAL applications and is completely separate to premium service appointments. You do one or the other, not both.

Ielts is general training: overall band score is 6

My understanding was once you have passed the test and used it for application, you don't need to retake the test. As you have qualified once and that would be valid for future applications Is this not true?

No, that is not an accurate assumption for dependents. Main PBS visa holders yes. She will need to have a current provider B1 test for Citizenship as well.

We have given this test for first spouse visa (period 2 years around) and to extend spouse (period 30 months) visa in 2015, it was accepted without any issue but we can't use this for ILR?
It doesn't makes any sense, if you have qualified once, why you need to give it again.

Because the levels required for spouse visa and ILR and citizenship are different.

Both.

Do you really want to risk a refusal for the sake of doing an English B1 SELT IELTS test??

I would rather not get it rejected
Specially when you have achieved the level required for ILR.

Can you please point to the documentation, which can clarify for me that for a spouse visa to ILR transition, english test need to be taken again.

Her score level from test, is still above the requirement for ILR and all the documentation i am reading points to, that HO will accept the old test score, please see below:

You can use a B1 level qualification that’s run out if both of the following are true:

it’s on the current list of recognised tests

Your answer: Last 2 years.

On Set(M) form regarding the cohabitation documentation it say(s)
"Documents addressed to you and your partner at the same address as evidence that you have been living
together continuously since your last grant of leave in this category. See Note 8."
What does since your last grant of leave in this category means, as extension on spouse visa was given 30 months ago.

Your choice on the old expired English test. I won't comment further.

Last grant of leave refers to the validity of the visa she currently holds, i.e. the 2.5 year extension.

Would you be able to answer if settlement checking service and premium visa service could be combined.

An applicant may decide to apply in person at a UK Visas and Immigration Public Enquiry Office (PEO) and would pay for a premium service. The settlement checking service is available as part of the premium application route. Merton Settlement Checking Service will check the application form is complete, correct supporting documents have been provided.

You can post your details on the forum and list all the documents and members can comment and advise before you apply in person at premium service centre (it that is what you plan, assuming you can get an appointment).

You can also use any settlement checking service, it does not have to be at your council.

I will post details here, I think that is a good option.

But can I use premium service centre and settlement checking service together?

I have never used it, only ever used this forum for advice etc and applied myself at premium centre and of course read the rules and requirements of my various categories of applications.

What do you think the "and" means?

If you have children under 18 who are living with you and who are applying for indefinite leave to remain as your dependants, then you are required to provide details.

Hi,

I am in a similar position with trying to interpret the English language requirements.

I have also used my wife's initial IELTS certificate in both the entry visa and the extension and in both circumstances this was accepted. She has also sat the test at an approved centre that is on the current list.

The score on the test is over the B1 level specified by the Home Office for ILR applications.

Can anyone comment any further as to whether we need to sit a further test or is this sufficient for the ILR application?

Hi seriously.wicked, did you use both the PEO & SCS in the end?

I'm thinking of doing the same since it will save me some grief & quite alot of money if i turn up for PEO and then get rejected for missing 1 document. Please let us know as it will be very helpful.
