ILR as spouse

I have been living with my spouse for the last 6 years in the UK

1. First 2 years on my own Tier 2 general Visa
2. Last 4 years as a Tier 2 Dependent

My spouse has ILR. Can I apply for ILR as a dependent based on the below rule:

-You must also have been living with your partner in the UK for at least:
5 years if you applied for your current visa on or after 9 July 2012

No you cannot. You need 5 years as a PBS dependent visa holder before you can apply for ILR.

You cannot use different visa categories, ie tier 2 general and tier 2 dependent, combined to make up 5 years. They fall under different immigration rules.
