ILR Dependants Application-Required Documents

Post by Haadiz » Tue Oct 29, 2019 4:59 am

Hi Senior's

I hope you all are doing well?

Since I am waiting for my ILR approval that has been submitted back in June 2019 which was due to expire along with my dependants early next month. I am now in the process of submitting my wife and a child ILR application in the next coming days, I would need some clarifications if someone can suggest on the following matters?

1. My Mrs and two children Tier 1 Dependant Visa was approved in August 2014, extension approved in November 2017, I believe they are now eligible for ILR application and the form we should use is Set (O)?

2. One of my Child who born in the UK back in 2008 and he is now on a dependant visa, we left straight after his birth and moved back to UK in 2014. I have been suggested not to apply for his ILR as he will be automatically illegible for British Citizenship as soon as one of the parent has ILR approved. Is this fine not to apply for his ILR and he wont considered as OVERSTAY?

2. If we submit the application well before visa expires but what happened if we are unable to book an appointment for document submission due to the limited spaces before the visa expire. Are we still fine as long as the online application was submitted but the appointment date is after the visa expiry?

3. For Cohabitation Doc's, Is this ok to submit our joint Mortgage letter and recent letter received from the lender regarding Mortgage payments history for previous year along with Help to Buy approval letter?

4. Since most of the documents are available online such as Utility Bills, Mobile phone bills, Credit Card, Bank statements etc. Can we just download them and submit online or do we have to order original from these sources?

I hope to hear back from Senior's and any help will be much appreciated.

Thanks

Actually it should be fine. Child was born in uk. I was a bit unsure since the entire family left UK.

From what I know, you should apply MN1 for him as he was born in UK.
You can apply MN1 once any one parent has got ILR.
So verily, with every difficulty, there is relief.

ILR Dependants Application-Very URGENT

Post by Haadiz » Fri Nov 01, 2019 4:28 pm

Dear Senior's

Firstly, thank you for your support and suggestions throughout the process.

I have managed to arrange the following list of supporting documents for ILR application of my Mrs. and
my Son. However, I will wait for my ILR approval before I apply for my eldest son British Citizenship who born in the UK back in 2008 but Currently on Dependant Visa and his visa expires in November 2019. I am not including him in the application and I hope this will not raise any concerns to the HO.

Please can you advise for any missing documents or am I good to go?

Main Applicant: (Tier 1 Applicant)

1. Current Passport
2. Biometrics (BRP)
3. Consent Form-Declaration (Form 1&2)

Dependant 1:

1. Documents Checklist-Home Office
2 Consent Form-Declaration
3. Current & Old Passports
4. Biometrics (BRP)
5. B1 Certificate
6. Pass Certificate-Life in the UK Test
7. Marriage Certificate
8. Cohabitation Documents
9. Travel History
10. National Identity Card

Dependant 2

1. Current Passport
2. Biometrics (BRP)
3. Consent Form-Declaration
4. Birth Certificate
5 School Letter
6. National Identity Card

I also would like to ask for the content of the covering letter.

1. Do I need to write in the letter regarding my current status of ILR application which has been submitted back in June 2019 and is still in process by providing them a case ID number?

2. Do I need to include my Son who born in the UK and not applying before his visa expiry and to inform that after any of the parent recieve ILR, will apply for his British Citizenship?

I am due to submit my dependants application tomorrow, I would like very much to hear back from the Senior member who can shed their light on the above matters.

Look forward to hearing back soon.

Thank you

A UK born child does not require ilr to register as british.

Note however that children over the age of 10 could be subject to the good character requirements.

Note also that if the child meets the requirements, they could have already applied on form T when they had 10 years residence.

Thank you so much for getting back to me promptly

I am with you and not applying for his ILR and would wait for my ilr approval. Unfortunately, he is net being in continuous resident for 10 years because of gap between 2008 when he left and came back in 2012.

Can you please check my documents and kindly advise if they all are good to go.

Thanks again

Hi Senior’s

I have submit my wife and a child application on Friday the 1st Nov and booked an appointment with UKVAS for 26th Nov. My dependants visas are due to expire today (7th) and I have all the documents are ready to be uploaded on the website.

Is this mandatory that all the documents must be uploaded on the website before visa expires or I still have the time until 26th November. I am still waiting for few document from utility companies to be sent via post.

Please advise

Thanks

Documents must be uploaded before the biometric appointment. Note that the date of supporting documents must be on or before the date of application and not the date of appointment.

Thanks CR001, much appreciated

Let me see if I understand your advice correctly. The issue dates of all supporting documents must be before the date of application submitted. However, these documents must be submitted before the biometric appointment, and it’s not mandatory to upload before visa expiry as long as the application was submitted visa expires.

Visa expires today, application was submitted but I will upload documents before biometric appointment?

Yes?

You are right about the child and if they contact me that why I have not included my 11 year child in the application then what should be my answer to their concern?

You simply state you will be registering the child under Section 1(3) of the British Nationality Act once your/your wife's ILR is approved. You could a covering letter stating this to submit as well.

Thank you CR001 to confirm the above

Regarding Cohabitation Documents, most of the documents are readily available online including Bank Statements, is this ok to download from the website and upload on UKCAS website or do I have to order originals? Please advise.

I am having a little issue here, I am not being able to find original Marriage Certificate but I do have a copy of that, is this ok to use (Scan)? Although, it is not possible to retrieve the original from home country before the Biometric appointment

Thank you and look forward to hearing back from you soon.
