ILR eligibility of a spouse who is not on a dependedent visa

Post by yargos111 » Wed Sep 29, 2010 1:12 pm

Hello,
I first came to UK in Jan. 2006 on WP along with my wife who was on WP-dependent visa. Last year my wife changed visa status to Tier-1 HSMP.

I am eligible to apply for ILR in Dec. 2010 but can I also apply for my wife's ILR along with my application.

Please let me know.

Kind Regards,
Yargos

No.

If you are still on WP (or Tier 2), then your wife will be eligible for settlement at the same time as you only if she changes her immigration status to your dependent (i.e.- dependent of WP migrant) before you apply for settlement. But this change in status can only be done from home country.

Hi,
I have recently got Tier2-General to complete my 5 yrs stay in UK (I had a gap of around 40 days from the time I got WP and landed in UK).

Does it mean my wife can still apply for ILR if she changes status from T1 to T2-dependent? If not, whar are the options for me to ensure she get ILR.

Thanks in advance.
