ILR extended

Hi

I would really appreciate some advice with this.

My wife has just applied for ILR under the 5 year route, She has been in the UK for 74 months already. We've just received a letter saying they will only extend this period by 30 months as she needs to complete at least 120 as this was the route she was last granted under. Plus £1000 Health Surcharge.

I must confess I had no idea the route she was on was for 10 years.

Not sure what my options are now as we're married with three children and we meet all the financial criteria. I was really hoping this whole nightmare was coming to an end.

At what point in the past did she not meet the requirements, ie English and financial?

What is her full UK immigration history?

All previous letters for visas would have stated under which immigration rule she was granted a visa. You need to read them to see when she was out on the 10 year route.

It does seem the original application was granted under rules D-LTRP.1.2 of appendix FM. This maybe due to using cash in the bank route as we had just returned from living abroad.

I have read that it is possible to switch to a 5 year route if an alternative source of income is possible, which it has been for many years now.

I believe it is possible to switch to a 5-year route, but that will reset her clock to zero and it will be five further years from the date that she is starts on the 5-year route.
