ILR for Tier 1 (General) Dependent

Hi

My present visa status is ILR.
My wife entered UK on Tier 1 (General) Dependent Visa on 11th July 2009 and will finish 2 years on 10th July 2011.
Her dependent visa is valid till 4th June 2011.
Looking at the 28 day rule even if she appies for ILR on 4th June 2011 she should have entered UK on 2nd July 2009 for her to be accepted for ILR.
I wish to know if she can still apply straightaway for ILR and Homeoffice can hold her Visa for additional 9 day period and grant her ILR or will she have to apply for FLR on FLR(M) form to cover the period of those 9 days
and then apply for ILR.

I am thinking... is your wife's status: Tier 1 dependent is valid now ? considering that you have changed your status from Tier 1 to ILR.

Is my understanding correct ?
I believe the route should be Tier1 Dep. --> Spouse visa --> ILR
Opinions from Guru's welcome to prove me wrong here...

hi cash123, as diago pointed she should have applied for dependant visa within 28 days using FLR-M form once you have received ILR? did this not happen? When have u got ILR?
