Post by klyn12345 » Fri Apr 23, 2021 11:11 am

HI all gurus, please need help.
My wife got her first Tier2 general dependent visa on 06/02/2014.
for my first daughter's birth she went to India on 18/11/2015 and came back on 02/08/2016. more than 180days.
My 2nd baby was born on 01/04/2021
I got my naturalization certificate on 22/03/21
I got my British passport n on 13/04/21.

1) can i apply ILR for my wife now. ore do i need to wait until 02/08/2016
2) can i apply for British passport for my 2nd baby directly
3) after my wife receives ILR can i apply for my 1st daughters Naturalisation with out ILR. do I need to have valid passport and Visa for my first daughters Naturalisation certificate. as her passport is expiring on 15/06/21 and she got her tier 2 until September

Please advise.. many many thanks in advance

1. Yes, she could have applied in February 2021 already.

2. Yes.

3. Your child born abroad is expected to hold ILR before she can be registered as British. Your child born abroad needs a valid passport to apply for ILR.

there is no absence limit for PBS Dependents if they have visas issued before 18th January 2018.

If she has a visa extension issued after this date, then the absence limit applies.
