Reasons for Absences-Tier1 ILR-Set(O)

Hi,
Apologies for creating this a seperate topic.

As part of the application for Tier1 E to Settlement they do ask about absences with dates and reasons and then evidence to justify these reasons.

I understand from the previous discussions that Tier1 E to settlment route, did not ask for to give the reasons/evidence.

Now if the travel are just the family visits what evidence are we suppose to send?

All previous passports will provide the travel dates but not the reasons and will they be handed over or be fully scanned each page?

This is something new, however, they do mention that it is applicable to Tier2 etc but there is no N/A option?

The only option are Employer letter etc and the best suitable for Tier1 E is “others”

If we select that(which we can’t skip) they ask for evidence to support “Other” :|


Any thoughts please.

Date of Entry?

When did you first enter the UK?

Is it the date of very first Entry or the date of entry to Tier 1 E

The straight forward answer is the first entry(In my case 27th March 2010) however, in paper form it was clarifying the entry to the route ILR application was based on.(In My case 29th March 2014)

Can someone Clarify this please!

Choose others and mention no evidence needed as Tier 1 E

Online form also clarifies that would be the start date your ILR is based on

Dear Members, hope all is good. Need an advice about when to apply- All relevant requirements are met.

1- Eligible to Apply for ILR under Tier 1 E on 01/03/2019
2- Eligible to Apply for ILR uner LR on 10/01/2020

Extension Valid Untill 02/10/2019

As I understand:
if I apply on or before 02/10/2019, I am assuming the process will take such amount of time that I will fulfill the LR requirement(10/01/2020)- around 3 Months Time Period.

However,I am keen to apply on 01/03/2019 as I am already in preparation and created two full time jobs for over 12 Months

God forbidden(you never know with home office) something goes wrong,where will I stand then, will I still be able to consume 3 Months if I apply on or around 2nd October 2019.

Ofcourse that is your choice which route to follow. You are assuming that your ILR via Tier 1 will take around 3 months and then you can vary it to LR. Assuming a “IF” there. What “if” its decided in 2 months or before than you could vary?
If you apply in March 2019 you will still have a valid leave till Jan 2020 regardless of the result (if I am correct)

Also note if you apply after April 2019 you can not rely on transitional arrangements(if you are).

You may want to see the new rules likely to come out in April 2019 where they are scrapping out the Tier 1 route and making many changes. I am not saying it will affect the existing applicants on similar route but I personally would apply for ILR via Tier 1 as soon as I can and get done with it given ofcourse you meet all the relevant requirements. You never know when they roll out new rules/changes etc!

I just went through this full thread again. You should do the same.
As has been previously advised, if you apply in March and it is refused, your extension until Oct is not impacted at all (unless they find reasons to curtail). You can then apply for 5 year ILR again in Oct

Marc Thanks for the advice again and I m going to apply in March.

As you advised that March application will have no impact at all(God forbidden, if unsuccessful and decided before Oct19),

Second Application in October 19 will also have an AR option and If AR applied and unsuccessful ,again 14 days to apply third time?
( these changes are compelling to think about every possible negatives🤔🙂)

1- I am due to apply on 28th Feb(completing 5 years :On Tie 1 E Issue date: 29th March 2014)

I will be providing personal Payslips for Dec 18, Jan 19 and February 19 to evidence the above(£1500 per month)- Will it be sufficient as an evidence of finances(I have 4 dependents although they will apply later)

I can include Dividend Voucher for last year or current year as well if advised.

2- I am also providing Personal Bank Statement of 52 days (Savings account of around £3000 started today :)-

Will that suffice the above?

There are no clear guidelines for this, but it looks like these would be sufficient.

There is no such requirement for payslips or personal statements for Tier 1

As I said, there is no requirement for it. However, you can send it optionally. Some members send payslips and 3 months bank statements. Really, it all depends what makes you feel good and comfortable as in the end its your application. Personally, I have sent 3 months bank statements only voluntarily.

2- Or Do we need to definitely get the paper copies/ stamped copies and then upload?

Although the new system says, the evidence can be originals or copies, I read somewhere in the guidancethat bank statements have to be originals otherwise online bank statements have to be stamped (if not originals).
I strongly believe online bank statements should be accepted but note the original paper bank statements are barcoded while pdf online versions are not barcoded. So I would not take the risk and take a scan copy of the original paper statement if I have an option to do so.

The requirement for statements being original or stamped is there in the guidance for the maintenance funds. That is very explicit. It is not explicitly stated for the business bank statements or for the personal statements for any other purpose.
