ILR (LR) absences

Hi guys

I`m a bit confused with the guidance I have received from solicitors and barrister. I just have one questions.

If a person has 554 days of absences in the 10 years, ie 14 days more than the allowed 540 days, is he/she still able to apply after 10 years?

As advice given is that 14 days is not a lot and the Home office mostly considers and gives discretion in this regards.

Probably not. You should be within the 540 days limit

Thanks for your reply.

When does the clock reset for the person to be in the 540 days? Let say a person came in SEP 2010 and by 2019 has exceeded thier 540 days. By Sep 2020 they would had been eligible to apply but due to the 540 day rule they can't.

Do they count the next 10 years when they were in the country for the whole 10 years without breaking the 540 days rule?

10 years and backwards from the date of application. Within that 10 years you cannot have more than 540 days of absence
