ILR PEO deferred Apps - Further checks/Additional docs cases

@ Ranga - Sorry that that the decision is deferred in your case. I hope the Senior Case Worker understands your case and grants you ILR. I can understand the dilemma and the doubts about getting Tier-1 extension instead. It is tricky but let's hope it works well for all of us.

@pkp - I hope the case worker has considered your case and granted your ILR already and arrives in post tomorrow.

In my case, the letters I had from my previous employer stated that I had to travel on Business trips for consulting engagements. I was required to travel frequently and extensively to Saudi Arabia and Egypt. They had given me an additional letter listing the dates and countries of all the Business trips while I worked for them.

The case worker said, that from the letters she did not understand why was I chosen for the trips or what was the role while I was on these business trips and has given a letter saying that I should provide a letter from my employer explaining the two questions.

I believe the case workers now expect detailed letter in such cases explaining the compelling need to travel for every single business trips.

I have requested my previous employer for the letter and also enlisted the services of the solicitor to prepare an additional cover letter and for advise on what else should I submit along with the additional letter from my employer.

The only reason we travel for business is because some jobs require travel. The travel was only in first two years of my HSMP and i believe there were no such restrictions at that time. I hope once I submit the additional documentation, the senior case worked understands the complete picture and uses his discretion to approve ILR.

Did you guys send a self addressed special delivery envelope with additional documentation, so that when they return it comes expedited.

I was informed by my solicitor , HO will wait for the 14 days period and only then process the application.

Hello dear brothers in similar situation!

Hope you are all well.

I too made an in person application on 3rd February. I was told my case is valid but they require additional document ( i.e an updated employment letter)

So I posted this to them on 6th Feb. Called the UKBA, connected to their internal post department who confirmed after taking my tracking reference number that they received my document on 8th Feb.

I am still waiting for my passports,

Sleepless days and nights.

The last post says they usually wait till 14 days (working days I assume) before they process the application, hoping this is the case......

ILR Bound Hope you hear back soon and get the decision in your favour.

What exactly did they mean by Updated employment letter? Was the later dated months before your application?

I believe there is a separate team of Senior Case Workers headed by a chief case worker that looks at the Cases when additional information is requested and received.

In a way it gives you a better chance as the Senior or more experienced case workers look at the application with a fresh view and then see if the information requested has been received and hopefully let's them take them decision positively if whatever information has been requested has been received.

the letter was all ok but was missing the SOC code, so had to get my employer to incorporate that into the letter.
Im from the 5 year WP route.

Guys you need to chase this up over the phone ...

One of my friend had a similar case and had to send additional document... they promised, they will process within 2 days of receiving the docs, when he didnt hear for 4 days, he started chasing this up everyday and finally had the passports sent back in 10 days from posting the additional documents.

It is clear the are getting tighter and tighter on immigration.

Any single detail missing which they know would most likely be ok for them to use their discretion they just play safe.

Request for additional documentation and then let honest, hard working full taxpayers immigrants wait for what is due to them as promised on initial HSMP and Tier -1 rules.

The number of days outside is being cut down drastically and probably being strict on every criteria.

Hope can throw some advice , what number did your friend call to chase the guys in the HO in my case its been 7 days since I posted the documents.

I need to travel for work reason so I need my passport.

Latest is that I heard back from my previous employer and they have very kindly created detailed letter answering HO's questions. Detail of every trip with need for travel and my role has been added to this letter.

I hope to get it in post tomorrow or saturday. Meantime I have heard back from the solicitor who has looked at my application and will now help me draft a cover letter and suggest if and what additional documentation I should supply along with this letter from employer that has been requested by the caseworker at UKBA.

Will try to send the additional documentation to Home office on Monday so that they should have it on Tuesday, well within the 14 days.

At the moment discussion has been around preparing and sending additional docs but will check with him on turn around time when I speak to him next.

You should be calling the PEO where you submitted the application ...

They may not give you the details on the outcome, but you need to keep chasing until they state your documents have been posted ...

I called up Croydon office today and was told the below information

1. Since additional documents were asked on the case, this will now be treated as a postal application
2. You are legally eligible to stay in the country until you hear back on the decision of your application ( even if it's after your visa expiry )
3. If you get a refusal with a right to appeal after your current visa is expired, you can stay in the country and appeal the case
3. If you get a refusal with no right to appeal after you current visa is expired, you have to leave the country and apply for an entry clearance visa ( not sure what that is for tier1 (general) application holders)
4. When I asked for the progress, they mentioned to me that they can't track less than 6 months old applications on their system n hence won't be able to help

My visa is due to expire in 2 weeks time, and i have urgent requirement t travel to my home country in 1 month time. Can someone please suggest if getting MP to contact them would help in anyways.

From experience of other people so far, people like Chrams whose decisions were deferred and some other people who either applied through PEO or via solicitors at PEO, they did their ILRs back within 2-3 weeks.

Keep faith, I hope you receive the good news and your passport with ILR approved within the next week.

Could you please let me know which number did you called ?

Also if the decision is refusal with right to appeal, can Tier 1 Extension be applied ?
