ILR application on spouse visa.

Hi, My wife is a british citizen. Icame to UK in july 2009.
I applied for ILR on SET (M) form on 5th July 2011.
Recieved a letter from home office that they recvd my application.
It has been 7weeks on 27th Aug, and have not heard anything yet.
Can anyone who has applied in this category, let me know how long did it take for them to get back their passport.

Hi everyone

Finally received the good news today!! My passport was waiting for me when I got home from work today (even tho no-one was home to sign for it....)

I used the new Settlement Checking Service for SET(M) which to be honest, is not really worth it seeing as it has not been much faster than normal postal applications. I used the one at Camden Council , the whole process took about 30 minutes - checking papers, photocopying etc which cost me £70 on top of the £972. The only good thing was that my husband got his passport back straight away.

Timeline:
Settlement Checking Service application: 08/06/2011
Acknowledgement letter dated: 10/06/2011
Payment Taken: 14/06/2011
Passport Received: 27/08/2011
Stamped in Liverpool: 16/08/2011

Waiting for ILR..............

After reading everyone elses comments I feel so silly for thinking that 6 weeks seems like an eternity to wait!

Me and my husband sent a letter to expedite the application because our offer has been accepted to buy a house.

I didnt know this forum existed - dont know if i appreciate the relief of knowing how long this should take - seriously, my heart goes out to everyone waiting cos this is a nightmare for me! if I had known any of this before applying i would have submitted a fast track service!

Please please anyone who has submitted an application around the same time as me, let me know of when/if they receive their ILR.

Hi all, I have Good news , and I was planning to call the Home Office to ask them to return it as I need to travel on the 6 of September
i sent it on 21 june
received acknowledgment on the 23rd
passport stamped on 16 August, Liverpool.
Received today 30 August ( 2 weeks after stamp) :D Ah well better than never.

I need your urgent response:

I sent my case on 17th August Home office received it on 18th August 2011. I received a confirmation letter on 22 August stating that they have forwarded my case to the case working unit.

I received another letter form Liverpool office stating that they are making my case invalid as "you have not attached any payments and have not filled the payment page" They have returned all my documents.

I was surprised as i did send them a cheque and did fill the payment page which is page no 3. I dont know what the hell home office did with the cheque and the payment page.

Now i have sent my case again with different mode of payment BUT problem is my Visa has expired on 21st August 2011 and now they will receive it on 31 August which is 10 days exactly late.

My question is will they consider my case and will they realize that its their fault that they have lost it. I have sent them the copy of cheque and copy of the payment page that was sent with the case along with the explanation letter.

Please please reply me as i am extremely worried????

Paper sent on SET (M) 16th June
Ack Received 20th June
ILR Stamped on 11 August (Liverpool)
ILR Received 30 August

So almost 10 weeks between sent and received!!

I think once you send the necessary proof (copy of chequebook etc, they should normally allow your application to proceed.

You must now be very releived. However, do you have any information to share with us regarding why you thought it took this long? Is there any particular issue with your application that we should be aware of?
Thanks! Yes it is quite a relief!

I applied on SET(0), Work permit + Tier 1.

After 14 weeks the Home office sent me a letter - they were unhappy with my degree certificates.

My degree certificates are in three languages (among them English), and if you look quickly you won't see the english text.

So of course they asked me for translated copies!!

So I sent them some photocopies of my certificates - but with the English text highlighted on the photocopies, and I sent a letter with explaining what I did and that they must have made a mistake.

That seems to have convinced them, as six weeks later (yesterday) I got ILR. I am very relieved - it was quite stressfull - my Tier 1 expired about a month back.

Hi all,

I started a new thread, but was redirected tot his one. My wife and I had been worried about how long it took to get a SET(M) application back, as stated on here, simply predicting that they 'aim to complete 95% within 6 months' is no help at all. They might as well say they aim to complete 100% within 10 years.

Anyway this thread helped a lot, and seemed to suggest that 10 weeks was not too fast to hope for.

Turns out though, just a couple of days after read the thread, the passport arrived this morning. We first applied on June 6th, but the application was return in early July because a bank error led to the payment being rejected (very annoying, all it would have taken was a phone call to confirm the details, instead we had to start again. We reapplied on 2nd July, and exactly 2 months later we have it back.

Also, it might help someone to know, I wrote to them at the start of August, I don't know if that helped. And then I was given the fax number a few days ago (0151 213 1481), but it doesn't seem to work, none of the faxes were being picked up. I was going to call again this morning to see what was going on, but there's no need now I suppose.

I'm still very annoyed with the home office that they can't give more information about the progress of applications. It would have saved a lot of worry and stress for us. All's well that ends well though.

FINALLY, my wife's passport and all our documents just dropped through our door about half an hour ago!

A couple of things to note - the ILR was stamped on August 18th, however I made two follow-up phonecalls on August 19th and 26th to check the progress of the application and was told both times it "had not yet been completed". On the 26th I asked if I, as a British national, could have my passport returned and the call handler put me on hold whilst she made enquiries and arrangements for this to be done. She came back and said the request had been processed and accepted. I think it's fair to say that phoning up to check progress is a complete waste of time as what the computer says and what the caseworkers are doing seem to be at odds with each other!

Also, the postman just stuffed the package through the door rather than get the required signature. No big deal really but some folk have asked what happens when the postman comes, sometimes they get a signature and clearly sometimes they don't.

Now my wife can take our four month old son to visit her family in Korea!

Our Timeline
April 4th: £900 payment taken (UK Border Agency, Croydon)
April 21st: Posted application by Special Delivery to DH1 9FS
April 26th: form received by Border Agency
May 5th: confirmation letter sent
May 28th: letter sent by Border Agency requesting we send new form and additional payment
May 31st: Posted new form by Recorded First Class to L2 0QN
June 3rd: new form received by Border Agency
June 16th: confirmation letter sent
June 21st: £72 payment taken (by cheque)
July 29th: Called to check progress
August 1st: Wrote letter to Border Agency requesting they speed up the progress of application
August 18th: ILR stamped in passport by Border Agency
August 19th: Called to check progress
August 26th: Called to check progress
September 2nd: Passport & documents received

Dear Members,

A very big thank you to everybody who gives priceless suggestions in this forum and help others solve their problems. Today good news has knocked the door and we (self + spouse + kid) have received ILR based on 1 yr WP+ 2 ye HSMP + 2 yr Tier1

I have made a silly mistake when I posted my application. I have not sent the cohabitation documents with my initial application and after few weeks when browsing for turn around timelines for ILR application in the internet, came across this forum and found that cohabitation docs are must after apr'11 applications and also its up to the discretion of caseworker ( as some PEO applicants have not been asked for these docs):shock: :shock: . Then after 6 weeks I have sent the additional documents (cohabitation docs, marriage certificate, birth certificate for kid) and a covering letter explaining the reason for the additional documents to the Liverpool address as mentioned in the SET(O) guidance notes. It looks like HO have considered these documents and have approved ILR for three of us I think just because I have sent these docs in time before my application was decided. Moreover I didnt had my original intial WP with me as my initial employer took it and didnt had any P60's or P45 for the inital 3 years :?. Below are my timescales.

Application posted : 16-Jun
Application rcvd by HO : 17-Jun
Ackn letter rcvd on : 23-Jun dated 20-Jun
Additional documnents sent date : 02-Aug (almost after 6 weeks)
ILR stamped : 19-Aug at Liverpool
ILR rcvd : 02-Sep

1. ILR SET(O) application form
2. Life in the UK cert for self + spouse
3. last 12 months payslips attested by HR ( as the payslips were on a normal paper)
4. last 12 months bank statements
5. previous HO letters from TIER1 exension and HSMP approval
6. Employer letter confirming the employment status

sent on 02-Aug

1. Marriage certificate
2. Kids birth certificate
3. cohabitaion docs for last 3 years from 6 diff sources

I HAVE NOT SENT ANY P60's or P45's

Its exactly 11 weeks and 1 day between application posted date and ILR delivered date. I will be very happy to answer any queries others have.

Hi all,

This is my first post but I've been reading updates on this forum, and this thread in particular for many months now.

I'm a British citizen (born and bred) and I married a Indian in 2008, my husband got a 2 year spouse visa soon after. We then applied for ILR using the SET M application and payment by card on 01.12.2010, we recieved an acknowlegment letter a few days later which was dated 02.12.2010.

Soon after I gave birth to our first child and thus quickly 'forgot' about the application. It wasn't until the little one was six months that we realised that we hadn't heard back from them. Then started the phone calls to check progress which were more infuriating than helpful as they don't really say much other than 'it's being processed', this continued until the seven and a half month stage at which poit I was told to write regarding an update on progress, I sent a letter to Croyden and to Liverpool. A seek after the letters I phoned again for a progress report and this time was told 'it's not yet completed', having pushed for more info I was told the application was lOoked at in December and then again in July. It seems the application was forgotten and only picked up again due to the letters I had sent them.

Today I had the knock on the door from the postman who finally had a large envelope to deliver (signed for) and it was our documents and mu husbands passport with his ILR.

Timeline:

Application: 01.12.2010
Ack letter: date- 02.12.2010, recieved: 05.12.2010
IRL issue date: 23.08.2011
Documents and passports recieved: 05.09.2010

Just over 9 months later! I know my story may sound like we weren't impatient but we were and it's the not knowing that really adds up. My advise to anyone whims due to apply, go in person; saving some money via a postal application isn't worth the heart ache. We only went with postal as I was heavily pregnant at the time and assumed we'd hear back in around six months as we were not going to need documents/passports soon after the birth of our child, but again in retrospect, I'd never apply by post again and nor would I recommend it to anyone.

Interesting! Your post shows you gave them the lattitude to relax as well. My take is that every application over 14weeks should attract a follow up letter! This allows an independent official to check what is going on. Another advantage is that if push comes to shove, the Tribunal wont accuse you of sleeping as well. At work we chase outstanding assignments, same policy should be accorded the HomeOffice! It works, just in case its forgotten in the drawer! We all human!

I dont think you need biometrics for ILR unless process has changed very recently...As I haev applied for ILR (1 yr WP + 2.5yr on HSMP + 1.5yr on T1) on 16th June and have got passports back with ILR stamped on 02 Sep....Its just time and I beleive you will aloso get yous may be in 2-3 weeks...

okay my biometric details have never been submitted (my tier 1 got stamped narrowly before the November 2008 mark , when biometric residence permits were made mandatory). I presume your biometrics must have been taken when you got your tier 1 which looks fairly recent. I'll still double check but I think mine will need to be submitted during the current processing.

I am Elsa my hub submitted our Set (O) App. for ILR under HSMP judicial review on June 13th, received acknowledgement on June 16th and payment taken on June 15th, its been nearly 13 weeks still waiting. We have planed to travel to India soon don’t know what to do? Any advise please.

I have been a silent viewer of this forum and really appreciate everyone's contrubutions. I hope all of are successfull with your applications. I had posted my application on the 11/06/2011 and recieved their acknowledgement on the 14/06/2011. Since then I have been waiting with no news from them whatsoever. Anyone in the same boat as me? If so kindly post your comments. Also it is now approaching the 14th week. Not sure if there is anything wrong with the application. Any comments from the board will be useful.

My application I think is straightforward. HSMP (JR) applying after five years of qualifying period of stay with my wife who is my only dependant. Did not require LUK test. Just had to show economic activity, which I have done sufficiently. Just one blemish I could say was that my current account was overdrawn. Spoke to a solicitor he said this will not be an issue. Posted 11/06/2011; Acknowledgement received 14/06/2011; Still waiting....
