Hi everyone

I am looking for advice in regards to my situation
I had a resident permit on descreationary grounds but now I made an applied for my ILR on the12th feburary 2016 (10 years route)

I recently gave birth to my son July 2015 which was before my application. I didn't add him with my application but my lawyer mentioned him in the cover letter and I sent my son's birth certificate as well. (On advice of my solicitor)

Well I just got my biometrics letter with another form asking if I have any further grounds for my application.

As you can imagine this has got me worried as my mum who did the same exact thing as me, didn't get this form with her letter.

Could this be a bad sign or is it just a procedural thing.

My solicitors can not come up with a specific reason why I was sent this form other than the HO want to inquire about the status of my son or sons father.

Any information is welcomed as I'm going slightly crazy just thinking about it. The only thing keeping me sane is looking after my son.

Thank you.

I submitted Set (M) application as British Spouse via county Nationality and checking service (Paid 90£) in Oct 2015. The case was straight forward and paid 1500 as Fee and I am still waiting for decision. Its more than 4 and half months and I am thinking why I sent my application by post. I had a choice to go on window and get decision on same day. I don't know to whom and what address I can contact to process my application quicker because I have to travel. Is anyone have idea, where I can contact to submit my request. Is anyone on Set (M) is waiting for decision?

Wish you best of luck with your application.

I read your post where you mentioned that you called Home office and requested for Biometrics can you please tel me which number did you call ? I have not received mine yet and i do need it despirately by this week to save my job.

Many Thanks
How is your application going? It is likely that your employer has had issues in the past regarding people lying about their application. Hopefully you have received your Biometrics letter by now, as they don't send out confirmation letters anymore. I would speak to you employer and show them the Post Office receipt of postage and explain to them your predicament. It is illegal to fire someone who is applying for a new visa, however I have no idea on the rules if you are not able to prove application. I would involve UKBA if the problem persists, maybe they can speak to your employer? I haven't received anything further.

Hello All,

What if you apply for ILR via post and after 4-5 months processing period (According to the thread) you will get a refusal? Will you still have right to AR or appeal? Or do you lose that right?

Thanks in advance.

ILR refused - Tier 1 Ent -Accelerated

Post by bkallday » Thu Mar 10, 2016 5:13 pm

Postal Application Refused:

ILR - Tier 1 Ent - Accelerated

Applied 15/10/15
Biometrics 05/11/15
Refusal Letter 5/3/16

After 5 long months my application has been refused. Apparently the guidance has changed in regards to the calculations of full time positions. The transitional arrangements for leave granted prior to April 2014 only apply to extension applications, not to indefinite leave to remain applications. This means that a full time position is 1 full year, for accelerated applications, but still can be a combination of months for extension applications. (For all applications made in regards to leave granted after 4/2014 the transitional arrangements do not apply.

I applied for my ILR in October, and the new guidance was issued in December after my application was posted. The caseworker came to a decision based on the new guidance, which was issued, well after I posted my application.

Any advice?

Hi,

I got my ILR approved in same day appointment and have now done SET (O) postal application for my dependents:

ILR form (SET O) posted via Special Delivery: 27 Jan 2016
Money deducted from bank: 29 Jan 2016
Biometric Enrolment Letter received dated: ??

It has now been 6 weeks since the money was deducted but we have not received the Biometric Enrollment letter yet.
Is this abnormal ? ( as i have seen in this forum that overwhelming majority received within days )
Does this indicate a possible issue in the application as HO are not sending the biometric enrollment letter ?
What could i do to check the status with them ?
Or wait is the only option ?

Hi Zullu41, you can contact Home Office and explain this to them. Keep your Post office receipt on hand while you call them so that they can look into your file. Good Luck...

Hi bkallday,

In you case I think seeking advice from a good solicitor would be ideal. Good Luck.

Yes i called HO number today and gave them the case ID ( which we received in the initial email from HO ). They checked and took all details and have sent them across to the depratment which sends the Biometric enrollment letter. We are now suppose to receive biometric Enrollment letter within next 15 days.

Received my BRP today after rearranged delivery. Thank you all the information shared in this forum.

This my timeline from Tier 2 General + 1 dependant:

ILR form (SET O) posted via Special Delivery: 29 Feb 2016
Fee paid by Credit Card: 02 Mar 2016
Biometric Enrolment Letter received dated: 05 Mar 2016
Biometric Enrolment done: 07 Mar 2016
ILR Approval Letter and Passports received by courier: 15 Mar 2016
BRP received by courier: 18 Mar 2016 (Rearranged from 1st attempt on 16 Mar 2016)

As you can see, that is less than 3 weeks (!!), much less than I anticipated. One thing I can say is that we put a lot of effort when we are submitting our applications, we filled the form electronically and we separated the documents on File Bag Document Holders and put stickers listing what every bag had. We tried to show everything as straight forward as possible so the officer taking the case could process it very quickly.

I hope this helps anyone going through a similar process. Let me know if you have questions.

Cheers
