Ilr via set DV immigration rules is completely separate and independent of British nationality laws. There is no special rule for ilr DV people when it comes to citizenship.

If you are divorced from your partner, you have to wait 5 years which must include 1 year on ilr.

If you are still married, it is 3 years before you can apply and you need your spouse's passport to apply.

Yes, the requirement is to be legally married. You can be separated no issue. However you will need your spouses passport and/or naturalisation certificate if applicable, to apply based on 3 years.

hi everybody, anybody got positive news yet? i sent my application and biometrics on march 2019,yet to receive anything back...theirs been correspondence asking for more documents but still awaiting their decision,its absolutely nerve wrecking having to wait so long for a decision

Hi, same here been waiting. My solicitor informed me that she has received a letter from Home Office asking for further documents with regards to MARAC as they did not find it being attached to the list of documents being submitted.

The letter was dated on 28th of August and they receive the document on 4th of September, since then no news

How about you?
When did you submit your application and the date of the letter you received from Home Office?
Did you track the mail?

yes i always use track mail and it showed it was delivered. i received request of more information on the 18th august which was signed for four days letter, my initial application was made on march along with biometrics..
i have a few questions please advice.
im not a uk citizen so it was required of me to pay the fee in full
ive got four British born children and are british citizens as their father is. question is was i supposed to apply and pay for them as well? please advice

If you are destitute and can not able to pay the visa fee and you do not have source of income, I think you are exempted to pay for the visa fees.

Hi all I post on behalf of my friend about SET(DV) timeline she live in the UK on leave to enter visa and she was the victim of domestic violence

Submitted destitution domestic violence (DDV) concession : 7 January 2019
DDV visa granted : 14 January 2019

ILR SET(DV) submitted : 11 April 2019
Biometric enrolment: 23 April 2019
Home office sent a letter for additional documents about she was the victim of domestic abuse : 7 August 2019
Submitted additional documents from Crown Office & Procurator Fiscal Service to Home Office : 27 August 2019
Received a letter from Home Office ILR visa has been granted : 16 September 2019 and the issue date was 12 September

Now she still waiting BRP card and all support documents from Home Office :)

Hello all,

I am writing on behalf of a colleague ( male ) who had been victim of DV, He submitted, Police report and his statement to police , GP report that what treatment he is receiving , some talking therapies, Victim support supporting letter confirming that he had been victim of DV and confirmation of a refuge centre . His visa was curtailed as his wife was black mailing him for some money as if he did not pay up she will inform Home office and when she realised that he made reports to the police she quickly informed to Home office. There was controlling behaviour and some physical assault also on him, but he successfully submitted the application before the curtailment date. he did not have to pay for the fee during the online application process as there was a option and he ticked that he is staying at a refuge.

My question is being a man is it normal to apply for DV, I am sure men face this problem too specially vulnerable men coming from abroad with no knowledge of UK law.

There is no rule that SET DV is for females only. It applies to anyone who is a victim and who has evidence that can be verified and authenticated by HO.

I understand that the rules are same for everyone. but based on these evidences do all expert think that he has a solid case. ( police report, GP and therapies report, Victim support letter and refuge letter stating that he was excepted for accommodation due to his DV ). But police report only says that the investigations are on going. GP report says that he had problems with his wife and he is suffering from serious depression and anxitey and being treated with medicines and therapies.

Impossible for strangers on an internet forum to advise if you have a solid case or not as we don't know the full circumstances or the other side of the story or have sight of any supporting documents.

With SET(DV), it all depends on HO and the supporting evidence.

Well all due respect these strangers on internet started this forum and the main reason of this forum is to discuss the timelines and the cases. i dont think anyone would be sharing their personal letters and evidences here online here so it all depends on the merit and the content of the letters provided by the authorities. can any men shed some light here and kindly share their stories of DV cases with HO. This victim here is highly stressed and being on suicide watch also. being a male victim he kept it to himself about the abuse he suffered from his wife and in laws. we are just helping him to stand back on his feet and start a new life .

No one can tell you whether he will be successful or not or whether HO will ask for more information or not. Set DV takes a few months as HO will verify everything before making a decision.

There is nothing he can do now but wait if he has submitted everything.

I understand,for set dv application you need to be in country which I am not.

I am currently in Pakistan, if I dont have the brp in hand is there a way to come back to UK so that i can apply for set dv?

Or, is there a way to initiate set dv application from overseas?
