Hi,

I understand, for set dv application you need to be in country which I am not.

I am currently in Pakistan, if I dont have the brp in hand is there a way to come back to UK so that i can apply for set dv?

Or, is there a way to initiate set dv application from overseas?

YS
If you do not have a BRP to prove to the airline that you have the right to enter the UK, then no, you will not be able to return.

Where is your BRP?? What is your UK immigration history?

You cannot submit an ILR application under any category from outside the UK. You can only apply for ILR within the UK.

Hi,
Thank you for your reply.
Me and my husband got into fight and I think he has the card.
Currently I am on spouse visa. But I would like apply for set dv.
If I notify the situation to visa office, can they help me returning to uk.
Or is there anything else i can do from here?
Thank you.

For SET(DV), you need evidence of the domestic abuse from GP, social services, police etc. If you have only had one single incident of a fight, I doubt you will succeed.

You should not have left the UK if you do not have your BRP.

When does your visa expire? What date was it granted?

You could try to apply for a replacement or single entry vignette by reporting your BRP lost.

We both are here now. My visa is till August 2020 and got visa in 2017.

If I apply for a replacement how long will it take to get a new one? Also do you think if he has told anything bad to visa office will it affect me getting visa?

You have to report it lost and apply for a single entry visa vignette. You then get a new brp to collect at the post office in the UK.

He said that he would ask to cancel visa, I am not sure if this has already been done or not.

If a report has already been made, is it likely that my vignette visa might be refused?

If he has reported the breakdown of the relationship, then yes you might not get a single entry visa vignette or if you get one, you might be denied entry to the UK and sent back to Pakistan.

Is there a known time from visa office from the day of reporting before they action on it? Or is it instantaneous?
Is there anything else that can be done from here?

Hello,

I wanted to see if somebody has been in the same situation as me.
I have applied for the ILR SET(Domestic Violence).
I would like to see if you can share with me your processing times. The waiting time without a feedback from Home Office is a total nightmare.

My case:
10/07/2018: Application submited
23/07/2018: Biometrics letter received and biometrics taken the same day at the Post Office.

How long did you wait for your result (was it positive, negative?)

Thank you a lot!
Hi is there any one who can guide me what documentary are required for ilr on basis of domestic violence

Hi,

Sorry for the late reply, the agency for domestic violence should advise you on this as they are the one who is going to refer your case to MARAC and if your case fall onto their criteria then you will receive a MARAC letter.
I hope this helps.

Hi,

I submitted Police Report, GP report, MARAC letter from the domestic violence agency, copy of my ex husband's passport, witness report, chat report from domestic violence agency which I contacted during the day I was assaulted by my ex, letter from Occupational Health and letter of support from my Line manager with the details that they know I was abused by my ex husband, my passport, bank statement.

I was on a spouse visa before and now I have ILR.

How about you?

Good afternoon,

Just to help people out....I have finally received notice that my ILR(DV) visa has been granted. I used an Immigration solicitor in my submittal, had fairly good evidence, own a business employing 14 people full time, North American, parent to a British minor, etc. and still it took approximately 3 months and 3 weeks to get approval.

After the first two weeks of waiting, there was a request to deal with the biometrics. After that there was no communication at all until last week when there was some more information regarding the abuse organizations that I had been in contact with.

Very grateful that I used an immigration solicitor to help with all of this. Have had to deal with the Home Office many times over the last 7 years and without a good solicitor, you are a sitting duck.

Now, I have to think carefully about my next steps. Worrying about getting kicked out of the country has now been somewhat taken off the table.

Hello
Good to hear that you got positive feedback. I am at same situation and need to apply soon. Could you please tell which solicitor you used? Thanks

Dear all

I thought i update the timeline of a friend.

Dv iLR applied : September 2019. ( proof of DV including police report. Report from victim support. Report from GP. Report from homeless charity that he is staying with them at a men refuge centre. )

HO requested updated in march 2020 asking for updated police report and his current residential status if he was still staying at the refuge. Also requested is updated doctors report.

His fees was waved off since he had no means to pay.

20th may. Received email from caseworker ILR granted. And BRP on its way.

Finally his message to all victims of DV is keep strong faith in Uk justice system and get all the evidences in place. Any questions i will be happy to lass it over to him.
